As used in this chapter:
PARKING METER
Shall mean a mechanical time measuring device which indicates
continually the available time remaining for a parked vehicle and
automatically indicates when the legal time limit has been exceeded.*1

Parking meters installed in the parking meter zones established as provided in Section
23:7-2 of these Revised General Ordinances shall be placed as follows:
a. Upon the curb immediately adjacent to the individual parking places
hereinafter described. Each parking meter shall be placed or set in
such manner as to show or display by a signal that the parking space
adjacent to such meter is or is not legally in use. Upon each parking
meter installed there shall be indicated by a proper legend the legal
parking time established by the City or other designated Authority,
and when in operation, shall indicate on and by its dial and pointer
or upon a clearly legible digital screen the duration of the period
of legal parking and on the expiration of such period shall indicate
illegal or overtime parking; no parking meters shall be so installed
in any location that standing or parking thereat would infringe upon
or violate the provisions of N.J.S.A. 39:4-138.
b. Upon the curb or sidewalk adjacent to a number of individual parking
places which are controlled, regulated and/or metered by a single
or "multispace" meter. Upon each multispace meter so installed there
shall be indicated by a proper legend the legal parking time established
by the City or other designated Authority, and the space or spaces
which the multispace meter controls, regulates or meters; no multispace
parking meters shall be so installed in any location such that standing
or parking thereat would infringe upon or violate the provisions of
N.J.S.A. 39:5-138.

The director or other authorized Authority is hereby authorized
and instructed to have lines or markings painted or placed upon the
curb or upon the street, or both, adjacent to each parking meter or
multispace meter which controls that parking space for the purpose
of designating the parking space for which the meter is to be used
and each vehicle parked adjacent or next to any parking meter shall
park within the lines or markings so established.
No person shall park any vehicle across any such line or marking
or park the vehicle in such position that the same shall not be entirely
within the area so designated by such lines or markings.

No person shall park a vehicle in any parking space upon a street alongside of and next to which a parking meter has been installed during the restricted and regulated time applicable to the parking meter zone in which such meter is located unless a coin or coins of United States currency of the appropriate denomination as provided in this chapter shall have been deposited therein, or shall have been previously deposited therein for an unexpired interval of time, and said meter has been placed in operation. The City or a designated Authority may from time to time implement technology which allows any person to pay for parking by use of a cellular telephone, laptop or personal computer, or other electronic device or devices in lieu of a coin or coins of United States currency of the appropriate denomination as provided in this chapter shall have been deposited therein, so long as the amount permitted to be charged as provided in §
23:5-13 is charged to the person for parking; and, further provided, that no surcharge for such services shall be permitted in excess of reasonable and customary banking, electronic fund transfer, debit or credit card charge as may be charged to the person by his or her bank, credit card of other financial service; and, further provided that no surcharge for such services shall be permitted in excess of reasonable and customary rates which may be charged to the person by the company which provides such technical services to the City or a designated Authority for the convenience of said person as is set from time to time in accordance with any contract for the provision of such services within the City or a designated Authority.
No person shall permit a vehicle within his/her control to be
parked in any such parking meter space during the restricted and regulated
time applicable to the parking meter zone in which such meter is located
while the parking meter for such space indicates by signal that the
lawful parking time in such space has expired. This provision shall
not apply to the act of parking or the necessary time which is required
to deposit immediately thereafter a coin or coins in such meter.
No person shall park a vehicle in any such parking meter space
for a consecutive period of time longer than that limited period of
time for which parking is lawfully permitted in the parking meter
zone in which such meter is located, irrespective of the number or
amounts of the coins deposited in such meter.
The provisions of this section shall not relieve any person
from the duty to observe other and more restrictive provisions of
this Title and any State statute prohibiting or limiting the stopping,
standing, or parking of vehicles in specified places or at specified
times.

No person shall deposit or cause to be deposited in a parking
meter a coin for the purpose of increasing or extending the parking
time of any vehicle beyond the legal parking time which has been established
for the parking space adjacent to which the parking meter is placed.

No person shall cause, allow, permit or suffer, any vehicle
registered in the name of, or operated by such person to be parked
overtime or beyond the period of legal parking time established for
any parking meter zone, as herein described.
No person shall permit a vehicle to remain or be placed in any
parking space adjacent to any parking meter while the meter is displaying
a signal indicating that the vehicle occupying such parking space
has already been parked beyond the period of time prescribed for such
parking space.

No person shall deposit or cause to be deposited in any parking
meter, multispace meter or by electronic means any slug, device, false,
fraudulent or unauthorized electronic fund transfer or metallic substitute
for a coin of the United States currency.

No person shall deface, injure, tamper with, open or willfully
break, destroy or impair the usefulness of any parking meter installed
under the provisions of this chapter.

It shall be the duty of police officers of the city acting in
accordance with instructions issued by the director, or Parking Enforcement
Officers of the Parking Authority of the City of Newark to report:
(a) The number of each parking meter or the number of the parking space
controlled by a multispace meter and the number or other identification
of the multispace meter which controls that numbered parking space
which indicates that the vehicle occupying the parking space adjacent
to such parking meter or controlled by such multispace meter is or
has been parked in violation of any of the provisions of this chapter.
(b) The State license number of such vehicle.
(c) The length of time during which such vehicle is parked in violation
of any of the provisions of this chapter.
(d) Any other facts, a knowledge of which is necessary to a thorough
understanding of the circumstances attending such violation.

Electronic Parking Charges Permitted in All Zones
|
In addition to the above rates set forth in this subsection,
the City or a designated Authority may from time to time provide for
technology which allows any person to pay the above rates for parking
by use of a cellular telephone, laptop or personal computer, or other
electronic device or devices in lieu of a coin or coins of United
States currency of the appropriate denomination as provided in this
chapter shall have been deposited therein, so long as the amount permitted
to be charged as provided above is charged to the person; and, further
provided, that no surcharge for such services shall be permitted in
excess of reasonable and customary banking, electronic fund transfer,
debit or credit card charge as may be charged to the person by his
or her bank, credit card or other financial service; and, further
provided, that no surcharge for such services shall be permitted in
excess of reasonable and customary rates which may be charged to the
person by the company which provides such technical services to the
City or a designated Authority for the convenience of said person
and is set from time to time in accordance with any contract for the
provision of such services with the City or a designated Authority.

A parking meter zone is hereby established in the following municipal parking areas as designated in Section
23:9-1 of this chapter.
a. The following portion of the Green Street parking area:
Beginning at a point in the southerly line of Green Street distant
118 feet, more or less, westerly from the intersection of the westerly
line of Mulberry Street and the southerly line of Green Street; thence
1. Southerly, 78 feet, more or less; thence,
2. Westerly, 62 feet, more or less; thence,
3. Northerly, 78 feet, more or less, to the southerly line of Green
Street; thence,
4. Easterly, along the line, 62 feet, more or less, to the point of
beginning.

For purposes of this chapter, a special event is any event which is held at any of the venues listed in Parking Zones 4 where the general public is invited to attend and a fee is charged for admission. The following streets or portions thereof in Zone 4 are areas designated by the City which are subject to the Special Event Parking Rate in addition to any regular rate as may be set forth in Section
23:7-13, above: both sides of the following streets or portions thereof are intended unless otherwise specifically set forth:
