N.J.S. 30:5B-17, Family Day Care Provided Registration Act provides for the voluntary registration of family day care providers to assure care, maintenance and supervision for family day care. The Division of Youth and Family Services in the State Department of Human Services has the responsibility and authority to contract with family day care sponsoring organizations for the voluntary registration of family day care providers and shall adopt regulations for operation and maintenance of same.

Family Day Care Services, N.J.A.C. 10:126-5.4, provides that each registration period shall be for three years. The certificate shall be issued to a specific provider at a specific location and shall not be transferable. See also subchapter 6, Safety, Health and Program Requirements for Provider Controls, specifically N.J.A.C. 10:126-6.1.

a. 
Places where children are given day care shall mean any institution or place, whether known as a day nursery, nursery school, day-care center, child-play or progressive school, or under any other name, which, for compensation or otherwise, receives for temporary custody, with or without stated educational purposes, during part or all of the day, apart from their parent or legal guardian, any child or children up to the age of 16 years.
b. 
Places receiving children for care between the ages of two and five years approved by the New Jersey State Department of Education shall be maintained in conformity with the regulations of this Article but without issuance of a license.
c. 
This section shall not apply to (1) foster care for children as referenced in Section 16:6-1, and (2) to public or parochial school authorities.

The Director is authorized to adopt rules and regulations governing the conduct and operation of places where children are given day care. All such places shall be conducted and operated in accordance with this section and such rules and regulations.

Any place licensed under this Article and its records, shall be open to inspection at all times by duly authorized representatives of the Department of Health and Community Wellness.

An applicant for a license to operate a place where children are given day care shall make application to the State Department of Human Services, Division of Youth & Family Services (DYFS).
