As used in this chapter:
CRUISING
Shall mean the driving of a taxicab or limousine (livery
service) on the premises of Newark International Airport, Pennsylvania
Station and any other public transportation facility in the City of
Newark in search of or soliciting prospective passengers for hire.
LIMOUSINE OR LIVERY SERVICE
Shall mean any automobile or motor vehicle with a carrying
capacity of not more than nine passengers, not including the driver,
used in the business of carrying passengers for hire which is held
out, announced or advertised to operate or run or which is operated
or run over any streets or public highways within the jurisdiction
of the City of Newark, and which is hired by charter or for a particular
contract, or by the day or hour or other fixed period, or to transport
passengers to a specified place or places, or which charges a fare
or price agreed upon in advance between the operator and the passenger.
PERSON
Shall mean any person, firm, partnership, association, corporation,
company or organization of any kind.
TAXICAB
Shall mean a motor vehicle, commonly called taxi, which is:
a.
Constructed so as to comfortably seat not less than four passengers
exclusive of the driver; and
b.
Engaged in the business of carrying passengers for hire; and
c.
Held out, announced or advertised to operate on and over the
public streets of the City; and
d.
Accepts persons who may offer themselves for transportation
from a place within the City; and
e.
Not operated over a fixed route; and
f.
Not more than 42 months of age at the time it first becomes
engaged in the taxicab business within the City of Newark.

a. No driver of a taxicab, limousine or motor vehicle used for the purpose
of providing livery service shall cruise in search of passengers at
the Newark International Airport, Pennsylvania Station or any other
Public Transportation Facility.
b. No driver of a taxicab, limousine, or motor vehicle used for the
purpose of providing livery service shall cruise back and forth in
front of, or otherwise interfere with the proper and orderly access
to or egress from any area within the Newark International Airport,
its terminals and parking lots, Pennsylvania Station, its terminals
and parking lots, or any other public transportation facility.

a. No driver of a taxicab, limousine or motor vehicle used for the purpose
of providing livery service shall solicit passengers for hire at the
Newark International Airport, Pennsylvania Station or any other public
transportation facility under any circumstances with the exception
of approved taxicab and limousine or livery service stands, and including
but not limited to:
1. Standing inside the terminals and carrying placards with the names
of persons, destinations, or any other information printed thereon;
or
2. Standing inside the terminals and verbally offering service; or
3. Sitting inside the motor vehicle and verbally offering service; or
4. Standing outside the motor vehicle or in any other area on the premises
and verbally offering services or carrying placards with the names
of persons, destinations, or any other information printed thereon.
b. No driver of a taxicab, limousine, or motor vehicle used for the
purpose of providing livery service shall solicit passengers for hire
in a loud tone of voice or in any manner annoying any person, or obstruct
the movement of any person, or follow any person for the purpose of
soliciting patronage.

Any person found guilty of violating any provision of this chapter
shall, upon conviction thereof, be punished by imprisonment for not
more than 90 days, or by a fine of not less than $100, but not more
than $1,000, or both.
