The purpose of this article is to provide for the licensing and identification of dogs by the Town of Hoosick, to set appropriate fees therefor, and to make other provisions pursuant to the Agriculture and Markets Law Article 7.
A.
This article applies to all dogs in the Town of Hoosick.
B.
In the event that any dog owned by a nonresident is harbored within the Town of Hoosick, such dog shall be exempt from the identification and licensing provisions of this article for a period of 30 days, providing that such dog is licensed pursuant to the provision of the law of the area of resident of the owner.
A.
All dogs in the Town of Hoosick must be licensed and identified according to the applicable provisions of the New York State Agriculture and Markets Law Article 7.

B.
Commencing on the effective date of this article, dogs owned by residents of the Town of Hoosick shall be licensed by the Town of Hoosick, as set forth hereafter.
C.
Identification tags issued by the Town of Hoosick pursuant to this article shall include the words "Town of Hoosick, New York State," and contact information, including the telephone number, of the appropriate Town official.
D.
Application for a dog license may be made to the Town Clerk, and also to any animal shelter manager authorized by the Town of Hoosick to receive and harbor dogs within the Town.
E.
The fee for a spayed/neutered dog license shall be $5.50. The fee for any dog which is unspayed or unneutered shall be $13.50. These fees shall include the surcharge on licenses to be deposited in the New York State Animal Population Control Fund. Notwithstanding the foregoing, dogs listed as exempt pursuant to § 110 of the Agriculture and Markets Law shall not be required to be licensed or to pay any such fee in connection with such license.

Any dog found within the Town of Hoosick not having the appropriate identification tag required by this article or the required state identification tag, previously issued, may be seized by the dog control officer of the Town of Hoosick or any other police officer having the authority to enforce laws in the Town of Hoosick. Any dog seized in accordance with the provisions of this article shall be properly sheltered, fed and watered for the redemption period as herein provided in a facility designated by the Town Board of the Town of Hoosick.
A.
Promptly upon seizure of an identified dog, the owner of record of such dog shall be notified by the dog control officer personally or by certified mail, return receipt requested, of the facts of seizure and the procedure for redemption.
B.
If notification is personally given, such dog shall be held for a period of at least seven days after day of notice, during which period the dog may be redeemed by the owner.
C.
If such notification is made by mail, such dog shall be held for a period of nine days from the date of mailing, during which period the dog may be redeemed by the owner.
D.
In either case, the owner may redeem such dog upon payment of the impoundment fees to the Town of Hoosick prescribed by this article and by producing proof that the dog has been licensed.
Each dog which is seized shall be held for a period of at least seven days from the day seized, during which period the dog may be redeemed by its owner, provided that such owner produces proof that the dog has been licensed or duly purchases the appropriate license as required herein, and further provided that the owner pays the following impoundment fees:
A.
Thirty dollars, plus $15 for each 24 hours or part thereof, for the first impoundment of any dog owned by that person. An additional $15 shall be charged for weekends and holidays.
B.
Fifty dollars, plus $15 for each 24 hours or part thereof, for the second impoundment within one year of the first impoundment of any dog owned by that person. An additional $15 shall be charged for weekends and holidays.
C.
One hundred dollars, plus $15 for each 24 hours or part thereof, for the third and subsequent impoundments within one year of the first impoundment of any dog owned by that person.
This article shall be effective on January 1, 2011.
