Except as may be otherwise expressly provided in these Revised General Ordinances, the various statutory and other non-departmental agencies of the City government shall be under the supervision of the Mayor to the extent that such supervision is not inconsistent with the Charter and general laws applicable to such agencies respectively.
a. 
All non-departmental agencies created by the Mayor which bear the name "Council" shall be renamed to either one of the following: board, commission, agency or any other appropriate title which does not reflect the word "Council" and further, requiring all newly appointed agencies to follow the same.

a. 
No member of any board, agency or commission of the City of Newark shall directly or indirectly have an interest in any license issued by the Board of Alcoholic Beverage Control of the City of Newark; and
b. 
No later than 30 days after the date of the adoption of this section,[1] all present members or commissioners shall divest them-selves of any such interest or tender their resignation. All (prospective) appointees shall be required to submit on or before June 30th of each year, an affidavit to the appointing authority indicating their compliance with the requirements of this section.

c. 
The failure of any Board Member or Commissioner to comply with provisions of this section shall be cause for his or her removal.

The purpose of this section is to foster openness of government and provide citizens with information concerning the various appointed municipal positions which exist within the City of Newark.

The following terms used in this section shall have the meaning set forth below unless the context within which the term is used clearly provides for a different meaning:
APPOINTED MUNICIPAL POSITION
Shall mean any appointed position within the City of Newark government created either by statutory law or by ordinance or resolution and for which the Mayor or the Mayor's administration designates the appointee for approval. Examples of such positions are Municipal Historian, Tax Collector, or members of any board, commission, agency, council or committee of the municipality.
APPOINTING AUTHORITY
Shall mean the official or body which by virtue of statutory law or by ordinance or resolution is given the authority to appoint a person to hold a particular appointed municipal position.

The Municipal Clerk shall cause a register of appointed municipal positions to be prepared and maintained. Such register shall be made available on the City of Newark's website and at the Municipal Clerk's Office and shall set forth at least the following:
a. 
Title of each appointed municipal position;
b. 
Brief description of the position's powers and duties;
c. 
Any special credentials or qualifications required to hold the position;
d. 
The length of term for the position; and
e. 
The name of the person currently holding the position, the expiration date of his or her term, and the number of vacant seats on the various boards, commissions, agencies, or committees.

The Municipal Clerk shall maintain a current updated listing of all existing vacancies for each appointed municipal position within the municipality. Such list shall be made available on the City of Newark's website and at the Municipal Clerk's Office.

A vacancy shall not be filled for a period of 10 days from its posting, pursuant to Section 2:2-14.4, in order to allow interested persons time to submit applications as provided in Section 2:2-14.6, unless greater expediency is necessary for the proper functioning and/or carrying on of business of the City of Newark or the local agency upon which the vacancy has occurred.

The Municipal Clerk shall maintain an application form to be completed by any persons interested in serving in an appointed municipal position. Such application shall, at a minimum, contain the following information:
a. 
Name;
b. 
Address;
c. 
Telephone number;
d. 
E-mail address;
e. 
Appointed Municipal Position sought;
f. 
Qualifications/experience for position; and
g. 
Signature.

a. 
Any person interested in serving in an appointed municipal position may file an application for such position with the Municipal Clerk. Such application may be filed at any time, whether or not the appointed municipal position sought is vacant. A person may withdraw his or her application at any time.
b. 
The Municipal Clerk shall maintain a file of all applications for each appointed municipal position. Applications shall be considered void after a period of one year unless renewed by the applicant.
c. 
Filing an application does not guarantee that the applicant will be selected for the position for which he/she has submitted an application.

After a decision is reached filling the appointed municipal position, such decision will be posted on the City of Newark website and will also be available at the Municipal Clerk's Office.

If any sentence, paragraph or section of this Section 2:2-14, or the application thereof to any persons or circumstance shall be adjudged by a court of competent jurisdiction to be invalid, or if by legislative action any sentence, paragraph or section of this Section 2:2-14 shall lose its force and effect, such judgment or action shall not affect, impair or void the remainder of this Section 2:2-14 and are declared to be severable.

All ordinances or parts of ordinances inconsistent with any of the terms of this Section 2:2-14 are hereby repealed to the extent of such inconsistency or inconsistencies.

a. 
The objective of the Commission is to provide a framework and strategy to end homelessness in Newark. The Commission exists to assist individuals and families in their move toward independent living and self-sufficiency.
b. 
The Commission further exists to promote the safety and well-being of homeless persons, and those at risk for homelessness, in a manner that respects their dignity and worth.

a. 
The Commission shall define and make recommendations for a continuum of services, including a strategy to ensure funding, that will define policy, programs and a strategic plan to monitor and assess homeless services.
b. 
Review and make recommendations regarding the City of Newark's allocation of resources affecting homeless individuals and families.
c. 
Act as a catalyst for the mobilization and coordination of resources and efforts within the City that target the end of homelessness, and in particular, the end to unsheltered, chronic and veterans' homelessness.
d. 
Act as an advocate, for state and federal policies which impact homelessness within the City of Newark, upon request from the Mayor.
e. 
Enlist the cooperation of various ethnic, cultural, religious, civic and community organizations, labor organizations, fraternal and benevolent organizations, and other groups, to further support the end to homelessness in Newark.
f. 
Identify potential funding streams to support the projects and priorities of the City's goal to combat homelessness.
g. 
Encourage initiatives that may be utilized to support the end to homelessness in Newark.
h. 
Conduct an annual assessment of The Point in Time Count to assist the Commission in defining new, ongoing and changing needs within the population that the Commission is organized to serve.

a. 
The Commission shall consist of a minimum of 15 members, with a maximum of 30 members, representing the public and private sectors.
b. 
The members will be appointed by the Mayor with the advice and consent of the Municipal Council and shall serve at the pleasure of the Mayor.
c. 
All members of the Commission shall perform their duties without compensation.
d. 
The term of each Commission member shall not be more than three years and shall be staggered to allow for continuity. Initial appointments shall be for two or three years. Thereafter, terms shall be for three years, with members serving a maximum of two consecutive terms. Members who have served two consecutive terms may reapply for appointment after two years has elapsed.
e. 
At least one Commission member shall be an individual who has experienced homelessness.
f. 
The Mayor shall appoint a Chair and Co-Chair of the Commission whose terms shall be for two years.
