The following words and phrases, when used in this Part 6, shall have the meanings indicated, unless a different meaning clearly appears from the context:
CARTWAY
Portion of a street or highway improved, designed, or ordinarily used for vehicular travel, exclusive of the berm or shoulder or sidewalk, consisting of the area from curb to curb.
DEBRIS
Any material such as snow, ice, slush, water, stone, grass clippings, leaves, dirt, mud, brush or other objects that were not placed within the cartway or right-of-way by the Township or an authorized contractor.
OBJECT
Something that may be seen or felt.
PERSON
Person, partnership, corporation, association, or any other legal entity.
RIGHT-OF-WAY
A strip of land that is acquired by reservation, dedication, forced dedication, prescription, or condemnation, and is intended to be occupied by a road, crosswalk, railroad, electric transmission line, oil pipeline, gas pipeline, water line, sanitary sewer line, storm sewer line, and/or other similar use.
SIDEWALK
Portion of a street between the curblines or the lateral lines of a cartway and the adjacent property lines, intended for use by pedestrians.
STREET or HIGHWAY
The entire width between the boundary lines of a way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.

No person shall deposit or cause to be deposited any debris or object on any public cartway or remove any snow or ice from any portion of the public cartway and move it to any other portion of the public cartway for any reason whatsoever. No person shall remove snow, ice or sleet from private property, sidewalk areas, or driveways and deposit the same on the cartway of the Township.

Leaves and brush may be deposited within the right-of-way, but not within the cartway, during the dates established by the Board of Supervisors for spring and fall brush cleanup. No brush, leaves, debris or objects shall be placed in any drainage area, ditch, stream, river, culvert, inlet or catch basin within the public right-of-way of the cartway.

Anti-skid materials deposited in the right-of-way by the Township or PennDOT may be removed by a person from March 15 through April 30 of each year and properly disposed of by that person. No person shall rake, sweep, blow or dump anti-skid materials onto the cartway or place it in any drainage area, ditch, stream, river, culvert, inlet or catch basin within the public right-of-way.

Any person who shall deposit or cause to be deposited any debris or object on any public cartway such that it becomes necessary for the Township or its authorized contractor to remove said object or debris shall be responsible for payment of any cost incurred by the Township for such removal. The cost of such removal shall become a lien against said person's property and may be collected from said person in accordance with Pennsylvania law.

Any person who removes any object placed in the right-of-way or the cartway by the Township or its authorized contractor shall be charged for the cost of replacing such object. The cost of replacement shall become a lien against said person's property and may be collected from said person in accordance with Pennsylvania law.

Any person who shall violate any provision of this Part is guilty of a summary offense and shall, upon conviction thereof, be sentenced to pay a fine not less than $50 nor more than $300 and costs of prosecution or, in default of payment of such fine and costs, to undergo imprisonment for not more than 30 days. Each day that a violation continues shall constitute a separate offense.
