The terms used herein shall have the same meanings as such terms
are defined in the 2015 International Energy Conservation Code and
the New York State Uniform Prevention and Building Code unless the
context requires a different meaning.
CODE
Collectively, the 2015 International Energy Conservation
Code and the New York State Uniform Prevention and Building Code.
The code shall be administered and enforced by the Building
Inspector of the Village of Island Park in the same manner, to the
extent as and in accordance with procedure applicable to the Village
Building Code, except as otherwise provided herein.
Plans and specifications for construction of a building and
affidavit of compliance prepared by a licensed professional engineer
or architect and certified that they are in compliance with the code
shall be deemed acceptable under the code to the Building Inspector
of the Village of Island Park for the purpose of issuing a building
permit or other similar approval necessary to commence construction.
A certification by a licensed professional engineer or architect
that construction has been completed in compliance with the code may
be accepted by the Building Inspector of the Village of Island Park
as evidence of such compliance for purposes of issuing a certificate
of occupancy or other similar approval or authorization for occupancy
or use of the building.
If the Building Inspector of the Village of Island Park determines
that a building subject to the code is not in compliance with such
code, he shall allow at least 30 days or such other period of time
as may be applicable under the Village Building Code, whichever is
longer, for such compliance.
Any person having been served with an order pursuant to the
provisions of this article and who fails to comply with such order
within 30 days after such service or within the time fixed by the
Building Inspector of the Village of Island Park for compliance, whichever
is greater, and any owner, builder, architect, engineer, contractor
or subcontractor taking part or assisting in the construction or use
of any building who shall knowingly violate any applicable provisions
of the code or any lawful order of the Building Inspector of the Village
of Island Park made thereunder shall be punishable by a fine of not
more than $500 or by imprisonment for not more than 30 days in jail,
or both.
