No person, political party, club or organization of any kind shall post, place or attach on or upon any tree, pole, fence or other structure in or along any street, alley or sidewalk in the Borough, any circular, handbill, poster, temporary sign or other advertising matter without having first secured a permit therefor from the Borough Secretary.

Any person, political party, club or organization desiring to post, place or attach a circular, handbill, poster, temporary sign or other advertising matter on or upon any tree, pole, fence or other structure in or along any street, alley or sidewalk in the Borough shall first register with the Borough Secretary, stating the name and address of the person or the organization desiring to post or place such material and furnishing such other information as may be reasonably required. Upon such registration being completed, and upon the deposit of $50 with the Borough Secretary, the Borough Secretary shall issue a permit which shall specify the time within which the material posted shall be removed, which time shall not exceed 10 days following the event specified in the circular, handbill, poster, temporary sign or other advertising matter. No person shall fail to remove such material within such period of time.

If the circulars, handbills, posters, temporary signs or other advertising matters are not removed or taken down on or before the expiration date provided in the permit, the Borough Secretary shall give notice in writing to the person to whom the permit has been issued directing him or her to remove the material within 10 days of the date of the notice.

The failure of any person or organization to remove the materials posted within the time specified in the permit or within the time allowed in the notice required by § 610.03 shall result in the forfeiture of the deposit required under § 610.02. Such deposit shall be used to defray the costs to the Borough in removing the posted materials. Such forfeiture shall be in addition to the penalty provided in § 610.99.

A person who wishes to place any advertising material on a bench in the Borough shall apply to the Borough Secretary for a permit therefor and shall pay an annual fee as set forth in § 208.02(A) of the Administration Code. A person who changes advertising material on a bench in the Borough shall also obtain a permit therefor and pay a fee as set forth in § 208.02(A) of the Administration Code.
