The Township of Pequannock determines and declares that there should be a public health system operated through a public health utility which provides for the delivery of public health to all residents within the Township of Pequannock. The benefits of such a system should include, but are not limited to, a modern and manageable array of public health services; the development of an integrated systems approach for local public health; cooperation among community partners to protect and improve the health of the residents; a reliable and cost-effective public health system; protection and promotion of physical and mental health; and prevention of disease, injury, and disability, thereby assuring the health of the citizens of Pequannock Township.
For the purpose of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:
PUBLIC AND COMMUNITY HEALTH ACTIVITIES
Programs and activities as established in Public Health Practice Standards of Performance for Local Boards of Health in New Jersey (N.J.A.C. 8:52-1.1 et seq.).
PUBLIC HEALTH UTILITY
A self-liquidating agency, with a dedicated budget, created to provide public and community health activities. Said utility operations are separate and distinct but not autonomous from other municipal operations as provided for under N.J.S.A. 40A:4-34 through 40A:4-36.
A Public Health Utility is hereby created to deliver public and community health services as provided by law. Said Utility shall be self-liquidating with a dedicated budget as provided by N.J.S.A. 40A:4-34 through 40A:4-36.

Funding for the Public Health Utility's activities may include, but not be limited to, the following:
A. 
Interlocal public health services contracts with participating municipalities.
B. 
Public health permit, licensing, and inspection fees.
C. 
Vital statistics fees.
D. 
Other funds or income obtained from federal, state, local, and private grants, commissions, fees for service, or revolving funds.
All revenues generated by or on behalf of the Public Health Utility shall be deposited in a Public Health Utility Fund and used exclusively for the Public Health Utility.
The Township of Pequannock Board of Health shall adopt an operating budget for the Public Health Utility each fiscal year. The operating budget shall set forth for such fiscal year the estimated revenues and the estimated costs for operations and maintenance and debt service.
