Article III: Curb Marking Restrictions.

§ 245-13 Enactment and title.

This article shall be entitled "Curb Marking Restrictions Law" and will add a new article to Chapter 245 of the City Code.

§ 245-14 Authorization, purpose and intent.

The City has determined that, upon the interest of citizens to mark street curbs, such markings could be dangerous and confusing and therefore should be prevented.

§ 245-15 Definitions.

As used in this article, the following terms shall have the meanings indicated:

CURB

A vertical or sloping member along the edge of a roadway clearly defining the pavement edge.

MARKING

Any writing, painting, drawing, staining, carving, edging or other marking made by the use of chalk, paint, ink, air spray can, knife, pencil or any other marking device and/or material of any work name, lettering, inspection, figure, design or other representation made upon a portion of the curb (as defined above).

§ 245-16 Rules.

It shall be prohibited to mark any curb located on any local highway, street, roadway, or vehicle pathway in the City of Cortland.

Any such marking existing at the time of the passing of this article shall be removed on or before April 1, 2021.

§ 245-17 Penalties for offenses.

Any violation hereunder shall be punishable by a fine of no less than $200 and no more than $750 and shall include reimbursement for any cost of restoring the curb incurred by the City of Cortland.

§ 245-18 When effective.

This article shall take effect immediately upon filing in the office of the New York Secretary of State in accordance with the Municipal Home Rule Law.
