All ordinances, amendments and supplements thereto
heretofore adopted by the Township of Bridgewater establishing fees
and costs inconsistent with the fees and costs set forth in the within
chapter are hereby repealed.
The following schedule of fees shall be charged
from and after the effective date of this chapter:

(1) Basic costs and formulas for copies of government records.
(a)
Per page:

d) below shall prove applicable.
(c)
Whenever the nature, format, manner of collation, or volume
of a government record embodied in the form of printed matter to be
inspected, examined, or copied pursuant to this section is such that
the record cannot be reproduced by ordinary document copying equipment
in ordinary business size or involves an extraordinary expenditure
of time and effort to accommodate the request, the public agency may
charge, in addition to the actual cost of duplicating the record,
a special service charge that shall be reasonable, based upon the
actual direct cost of providing the copy or copies, and in accordance
with the Open Public Records Act, any amendments thereto and the decisions
of the Government Records Council and Courts of the State of New Jersey
interpreting same.
(d)
The custodian shall permit access to a government record and
provide a copy thereof in the medium requested if the public agency
maintains the record in that medium. If the public agency does not
maintain the record in the medium requested, the custodian shall either
convert the record to the medium requested or provide a copy in some
other meaningful medium. If a request is for a record in a medium
not routinely used by the agency; not routinely developed or maintained
by an agency; or requiring a substantial amount of manipulation or
programming of information technology, the agency may charge, in addition
to the actual cost of duplication, a special charge that shall be
reasonable and shall be based on the cost for any extensive use of
information technology, or for the labor cost of personnel providing
the service, that is actually incurred by the agency or attributable
to the agency for the programming, clerical, and supervisory assistance
required, or both, all in accordance with N.J.S.A. 47:1A-5(d) of the

Games of chance licensing. The fees assessed by the Township
for all games of chance shall be equal to the fee adopted and assessed
by the New Jersey Legalized Games of Chance Control Commission (LGCCC)
pursuant to that agency's most recent fee schedule. The fees assessed
by the Township shall be in addition to any fee assessed pursuant
to the regulations of the LGCCC. The Township Clerk shall have the
authority to issue licenses on behalf of the Township for all legalized
games of chance to be conducted therein.

(1) Duplication of government records pursuant to OPRA. Pursuant to a
proper OPRA request, the fees and formulas to be applied in determining
the cost of copies of disclosable government records shall be as follows:
(a) If the actual Township costs for duplication of a government record exceed the statuatory rates set forth in Subsection
C(1)(e) [1] through [8] below, the Township shall charge the actual cost of duplicating the record. The actual cost of duplicating the record shall be the cost of materials and supplies used to make a copy of the record, but shall not include the cost of labor or other overhead expenses associated with making the copy, except as provided in Subsection
C(1)(e)[2] articulated below.
(b) Whenever the nature, format, manner of collation, or volume of a
government record embodied in the form of printed matter to be inspected,
examined, or copied pursuant to this section is such that the record
cannot be reproduced by ordinary document copying equipment in ordinary
business size or involves an extraordinary expenditure of time and
effort to accommodate the request, the Township may charge, in addition
to the actual cost of duplicating the record, a special service charge
that shall be reasonable, based upon the actual direct cost of providing
the copy or copies and in accordance with the Open Public Records
Act, any amendments thereto and the decisions of the Government Records
Council and Courts of the State of New Jersey interpreting same.
(c) The Township shall permit access to a government record and provide
a copy thereof in the medium requested if the Police Department maintains
the record in that medium. If the Police Department does not maintain
the record in the medium requested, the custodian shall either convert
the record to the medium requested or provide a copy in some other
meaningful medium. If a request is for a record in a medium not routinely

Township; or requiring a substantial amount of manipulation or programming
of information technology, the Township may charge, in addition to
the actual cost of duplication, a special charge that shall be reasonable
and shall be based on the cost for any extensive use of information
technology, or for the labor cost of personnel providing the service
that is actually incurred by the Police Department or attributable
to the Police Department for the programming, clerical, and supervisory
assistance required, or both, all in accordance with N.J.S.A. 47:1A-5(d)
of the Open Public Records Act and the Government Record Council and
the New Jersey court decisions interpreting same.
(d) Access to electronic records and nonprinted materials shall be provided
free of charge, subject to the Township's expense for the actual costs
of any needed supplies, such as computer discs.
(e)
The fee to be assessed for the duplication of a government record
embodied in the form of printed matter shall be as specifically set
forth below, unless the actual cost of duplication exceeds that specific
fee.

Copies of reportable and nonreportable motor vehicle accident
reports, per page, based upon the total number of pages per request,
including, but not limited to statements, laboratory reports and,
subject to permission from the Somerset County Prosecutor's Offers,
for autopsy and medical reports:

In accordance with Chapter
105 of the Laws of New Jersey, 1981, if copies of motor vehicle accident reports which have been prepared on N.J.T.R. forms are requested other than in person, an additional fee of up to $5 may be added to the fees set forth in Subsection
C(1)(e)[1] hereinabove to cover the administrative costs of the report. The additional fee shall not be applicable to related documents which may accompany N.J.T.R. reports.

defray administrative expenses of the Township in enforcing this provision.

The fee shall be paid at the time the retail
food establishment license is renewed for each time the owner or operator
of any food establishment fails to receive a satisfactory inspection
rating from the Division of Health. Fees and offenses are cumulative
for a period of two years from the date of the first offense. A license
transfer within the two-year period will void all previous offenses.
(c) The following fee shall be charged for food-handling
operations:

No person shall conduct, maintain or operate
a public eating establishment in the Township of Bridgewater who does
not successfully complete a course in food handling acceptable to
the Health Officer or other designated agent of the Board of Health.

M. Recreation fees. The Recreation Department reserves the
right to cancel, alter, supplement or limit registration or change
any dates, times, locations or ages or recommend the change in fees
listed on registration forms. There will be no refunds of registration
fees after the first class, practice or evaluation unless the Recreation
Department cancels the program. There will be no refunds if a program
does not run its full course of dates due to inclement weather, gym
cancellations or circumstance beyond the Bridgewater Recreation Department’s
control. If checks are made payable to an outside organization, refunds
will be handled through the outside organization in accordance with
their policies, terms and conditions.

is refunding participants due to a program cancellation, then an administrative
fee will not be collected. In the case of multiple children from the
same household requesting a refund on the same date, there will only
be one administrative fee of $10 charged.
(3) A late fee of $20 per family will be collected from participants
who register after the designated program deadline.
(4) A registration fee of $25 will be collected from participants who
are not residents of Bridgewater Township in addition to the Bridgewater
registration fee.
(5) A processing fee will be added to recreation programs in the amount
of $6 for programs with registration fees of $100 or less, $10 for
programs with registration fees between $101 and $200, and $15 for
programs with registration fees in excess of $200.
N. Electric
vehicle charging stations. The following fees shall be assessed for
usage of any electric vehicle charging stations operated by the Township
of Bridgewater:

A. In the case of federal, state and local governments and Boards of
Education, no fees shall be charged, except that the permittee shall
still be responsible for any costs incurred by the Township for third-party
services.
B. In the case of nonprofit, charitable or religious organizations,
the Township Council may by resolution waive any fees, except that
the permittee shall still be responsible for any costs incurred by
the Township for third-party services, pursuant to the following conditions:
(1) Only organizations having a Section 501(c)(3) designation under the
Internal Revenue Code and designated as a nonprofit under New Jersey
law shall be eligible to receive a fee waiver. Organizations designated
under Section 501(c)(4) shall be ineligible for fee waivers.
(2) The organization must perform nonprofit services within the Township
or perform nonprofit services directly benefitting the Township. An
organization that merely utilizes a facility within the Township but
does not provide services within or benefiting the Township shall
not be eligible for a fee waiver.
(3) Any organization charging an admission or promoting a fund-raising
activity shall not be eligible for a fee waiver.
(4) Notwithstanding these conditions, the Township Council reserves the
right to waive fees upon a showing of unique circumstances.
C. The provisions of this §
94-3 shall also apply to fees imposed in accordance with the other chapters of the Code of the Township of Bridgewater, except that the permittee shall still be responsible for any costs incurred by the Township for third-party services.
D. No person shall be charged a construction permit surcharge fee or
enforcing agency fee for any construction, reconstruction, alteration
or improvement designed and undertaken solely to promote accessibility
by disabled persons to an existing private residential structure or
any of the facilities contained therein.
E. A disabled person, or a parent or sibling of a disabled person, shall
not be required to pay any municipal fee or charge in order to secure
a construction permit for any construction, reconstruction, alteration
or improvement which promotes accessibility to his or her own living
unit.
F. "Disabled person" means a person who has an inability to engage in
any substantial activity by reason of any medically determinable physical
or mental impairment, including blindness, and shall include, but
not be limited to, any resident of this state who is disabled pursuant
to the Federal Social Security Act (42 U.S.C. § 416), or
the Federal Railroad Retirement Act of 1974 (45 U.S.C. § 231
et seq.) or is rated as having a disability of 60% or higher pursuant
to any federal law administered by the United States Veterans Act.
For purposes of this subsection, "blindness" means central visual
acuity of 20/200 or less in the better eye with the use of a corrective
lens. An eye which is accompanied by a limitation in the fields of
vision such that the widest diameter of the visual field subtends
to an angle no greater than 20 degrees shall be considered as having
a central visual acuity of 20/200 or less.
G. Members of volunteer organizations.
(1) Definitions. As used in this subsection, the following terms shall
have the meanings indicated:
ACTIVE MEMBERS
Individuals residing in the Township of Bridgewater who are
members of a volunteer organization and are defined as either active
or exempt members by the volunteer organization's bylaws.
FAMILY MEMBERS OF ACTIVE MEMBER
Includes husband, wife, child or children, father, mother,
grandparents and grandchildren, including any sibling, stepchild or
legally adopted child living in the same household.
FEES
Those charges for recreation programs, plumbing and fire
permits and building subcode, fire subcode, electrical subcode and
plumbing subcode inspections made by or through the Township Construction
Department in connection with the construction of a member or family
members personal residence. Specifically excluded from the waiver
of fees are any fees collected by the Township on behalf of another
entity (except for third-party independent vendors retained by the
Township to perform building, fire, electrical and/or plumbing subcode
inspections pursuant to the Uniform Construction Code), including
but not limited to the state, the county and/or such fees not directly
related to the member's or family member's primary residence.
VOLUNTEER ORGANIZATIONS
This includes the fire departments and first aid and rescue
squads located in or serving the Township.
(2) The Township shall waive fees to active members and family members
of volunteer organizations for the following:
(a)
Township recreation programs.
(b)
Fees associated with municipal plumbing and fire permits for
their personal residence.
(c)
Planning Board application fees for their personal residence.
(d)
Board of Adjustment application fees for their personal residence.
(e)
Fees for building subcode, fire subcode, electrical subcode
and/or plumbing subcode inspections through the Township Construction
Department in connection with the construction of their personal residence,
whether such inspections are made by Township subcode officials, themselves,
or by independent third-party vendors contractually retained for that
purpose by the Township.
