Every property owner owning property in the Township of Pine
shall maintain their premises in the manner prescribed by this chapter,
as follows, the same being minimum standards which are deemed to be
important for the protection of adjacent properties and property owners
and the health, safety and welfare of the residents thereof.
For the purposes of this chapter, and unless otherwise expressly
stated, the following words and phrases shall have the following meanings:
ABANDONED OR JUNKED MOTOR VEHICLE
Any motor vehicle which is inoperable and has been stored
or kept outside and not enclosed within a building on any private
property for more than 30 days; provided, however, that an inoperable
motor vehicle held or stored upon the property of a person engaged
in the business of servicing, repairing, storing or disposing of inoperable
motor vehicles in conformity with the Zoning Laws of the Township
of Pine shall not be considered an "abandoned or junked motor vehicle"
for the purpose of this chapter.
GARBAGE
Putrescible animal and vegetable wastes resulting from the
handling, preparation, cooking and consumption of food.
MOTOR VEHICLE
Any device in, upon or by which any person or property is
or may be transported or drawn upon private land, public highways,
street or roads, which is self-propelled, except by human power alone,
or drawn by a self-propelled vehicle.
RUBBISH
All putrescible and nonputrescible solid waste, including
garbage, refuse, ashes, dead animals and market and industrial wastes.
STRUCTURE
Anything constructed or erected, the use of which requires
permanent location on the ground or attachment to something having
a permanent location on the ground, including, but without limiting
the generality of the foregoing, advertising signs, outdoor advertising
signs, swimming pools, backstops for tennis courts and pergolas.
No owner or occupant or operator of any premises shall permit
thereon:
A. Abandoned, junked or partially dismantled motor vehicles. The storing of abandoned, junked or partially dismantled motor vehicles which pose a threat to the public health, safety and welfare shall be prohibited and shall be subject to the requirements of Chapter
134 ("Vehicles, Abandoned or Junked").
B. Infestation. All structures shall be kept free from insect and rodent
infestation. All structures in which insects or rodents are found
shall be promptly exterminated by approved processes that will not
be injurious to human health. After extermination, proper precautions
shall be taken to prevent reinfestation.
C. Sanitation. All exterior property and premises shall be maintained
in a clean, safe and sanitary condition. The occupant shall keep that
part of the exterior property which such occupancy occupies or controls
free of garbage, refuse and debris.
D. Structures. The exterior of a structure shall be maintained in good
repair, structurally sound and sanitary so as not to pose a threat
to the public health, safety or welfare. No person shall willfully
or wantonly damage, mutilate or deface any exterior surface of any
structure or building on any private or public property by placing
thereon any marking, carving or graffiti.
E. Vegetation. The accumulation of heavy undergrowth or vegetation which
would impair the health or safety of the neighborhood, nor shall they
permit any trees, plants or shrubbery or any portion thereof to grow
on their property which impairs the ability of any person to clearly
see oncoming pedestrian or vehicular traffic, so as to cause a traffic
hazard.
Any person, firm or corporation who shall violate any provision
of this chapter shall, upon conviction thereof, shall be subject to
a fine not to exceed a maximum of $500 plus costs of prosecution for
each offense. Each calendar day that a violation of this chapter continues
shall constitute a separate and distinct violation.
