A municipal airport, to be known as the "Hazleton Regional Airport" and owned and controlled by the City, is hereby established.

The following terms shall have the meanings specified:
AIRPORT
The Hazleton Regional Airport.
COMMERCIAL AIRCRAFT
Any aircraft holding an FAA Part 135 (charter) designation or operated as a business or for business purposes.
CORPORATE AIRCRAFT
Any aircraft holding an FAA Part 91 (corporate) designation or owned and operated by a corporate entity.
FAA
Federal Aviation Administration.
FACILITY USE FEES
Fees paid to the City of Hazleton or its designee by the owner/operator of transient commercial and corporate aircraft for the right to land at the Hazleton Regional Airport, to park on the ramps thereof, or to park overnight on facilities provided at the Airport by the City of Hazleton for such purposes.
FIXED BASED OPERATOR
The individual or corporation providing fuel dispensing and other aviation services at the Hazleton Regional Airport under contract with the City of Hazleton.
MGTW
Maximum gross takeoff weight.
ROTORCRAFT
A helicopter of any type, kind, or class.
SINGLE-ENGINE AIRCRAFT
An aircraft powered with one reciprocal/turbine engine.
TRANSIENT AIRCRAFT
All aircraft holding an FAA Part 135 (charter) or FAA Part 91 (corporate) certificate, any commercial aircraft or rotorcraft, or any privately owned aircraft of any type or kind which utilizes the facilities of the Hazleton Regional Airport on an itinerant or occasional basis. Specifically excluded from the definition of transient aircraft are the following:
A. 
All aircraft based at the Hazleton Regional Airport.
B. 
All aircraft operated by student pilots as part of their training.
C. 
All aircraft landing at the airport for maintenance at a City-licensed and approved FBO or limited commercial operator.
D. 
Emergency, military and government aircraft.

Facility use fees be and hereby are established for all aircraft using the facilities of the Hazleton Regional Airport.

A schedule of aircraft parking fees shall be imposed on all aircraft using the facilities of the Hazleton Regional Airport. (See the City Fee Schedule, which is amended by resolution of the City Council from time to time.)

The City shall be the agent for collection and administration of these fees.[1]
