As used in this article:
CENTER ISLAND
An area, not part of a driveway, between two rows of parking spaces.
COMMUTER
A resident of Denville or any other municipality using a Denville parking facility for commuting purposes.
DIVIDING STRIP
Any strips or area between parking spaces, or between parking spaces and the boundaries of a parking area, not part of a driveway or center island.
DRIVEWAY
A space within a parking area maintained for the travel, movement, and distribution of vehicles to and from parking spaces.
ENTRANCE
The area between the curbline of a street and the property line across which a vehicle may be operated in order to gain access to a parking area.
EXIT
The area between the curbline of a street and the property line across which a vehicle may be operated in order to depart from a parking area into a street.
MUNICIPAL FACILITIES
The area or places constructed for parking of motor vehicles at any facility, including, but not limited to, municipal buildings, parks, and recycling centers, owned or leased by the Township and shall include all real estate, driveways, roads, approaches and all appurtenances, but shall exclude off-street parking areas as defined in this article.
OFF-STREET PARKING AREA
The areas or places constructed or acquired or to be constructed or acquired and owned and operated or otherwise operated by the Township for parking of motor vehicles and shall include all real estate, driveways, roads, approaches and all appurtenances and facilities.
PARKING SPACE
Any space within a parking area marked or otherwise designated for parking a motor vehicle.
WALKWAY
Any portion of a parking area restricted to the exclusive use of pedestrian travel.

No operator or owner of a vehicle shall, at any time, within the areas designated in this section or within a municipal facility, park a vehicle, or permit the parking of a vehicle:
A. 
In any driveway.
B. 
On a crosswalk or walkway.
C. 
On a center island or dividing strip.
D. 
On any grass area or planted space.
E. 
In any entrance or exit from any parking area.
F. 
In any space other than within a single space designated for parking by pavement markings or otherwise.
G. 
From 3:00 a.m. to 6:00 a.m. on each and every day, unless:
(1) 
The owner of the vehicle holds a Township parking permit for the First Avenue Lot and parks the vehicle in a posted permit parking space of the First Avenue Lot, as shown in orange on the attached Exhibit A;[1] or

(2) 
The owner of the vehicle holds a Township parking permit for the Bloomfield Avenue Lot and parks the vehicle in a posted permit parking space of the Bloomfield Avenue Lot, as shown in orange on the attached Exhibit A; or
(3) 
With respect to a municipal facility, the operator of the vehicle is an employee of the municipal facility or a person having business at the municipal facility during such hours.
H. 
If the vehicle is over 9,000 pounds gross weight.
I. 
In posted spaces of the Bloomfield Avenue Lot during a snow event.
J. 
In the westernmost three aisles of the Bloomfield Avenue Lot each Sunday from 3:00 a.m. to 1:00 p.m., due to the Farmer's Market.

No operator or owner shall park a vehicle at any time within the parking areas set forth in Article III in spaces designated as permit parking (by signage and/or roadway markings) unless the vehicle is a passenger vehicle or has a gross vehicle weight of 9,000 pounds or less, and the owner of the vehicle shall have first applied to the Township for a permit to park the vehicle within the lot, and a permit has been granted by the Township and is suitably displayed on the vehicle.
A. 
Application for a parking permit shall be made upon forms that will be supplied by the Township Clerk.
B. 
The fee required to be paid for a parking permit shall be as set forth in Chapter 245, Fees, Rates and Charges.
C. 
Parking permits will be issued on a yearly (calendar year), six-month (January to June or July to December), monthly (calendar month) or daily basis for specific parking lot locations. Permit parking shall not be valid at any metered space unless money is put into the meter, or in any time-limit space in excess of the posted limit.
(1) 
Permits issued for the First Avenue Lot will be valid only in the First Avenue Lot.
(2) 
All other permits will be valid in the Bloomfield Avenue, West Main Street and Mt. Tabor Train Station Lots.
D. 
Permits are to be displayed in accordance with the following procedures:
(1) 
All permits must be hung on the rearview mirror, with the exception of special one-day permits, which must be displayed on the dashboard.
(2) 
Failure to display a permit in the foregoing locations shall result in the issuance of a summons. The fact that a current permit was issued shall not be deemed a defense if it is not properly displayed.
(3) 
Parking with a permit in a parking lot or permit parking location other than as designated on the permit will result in the issuance of a summons.
E. 
Permit regulations.
(1) 
Permits must be displayed as instructed above on the first day of the permit period and each day thereafter.
(2) 
Permits shall be required during the periods of operation set forth in § 374-20.
(3) 
Vehicles should be locked at all times. Denville Township shall not be responsible for lost permits or any personal possessions in vehicles.
(4) 
All permits are transferable between vehicles, but may be used only in the lot or lots designated in the permit.
(5) 
For all lots designated in Article III, the Township Clerk's office will issue parking permits either by mail or in person at the Clerk's office on a first-come-first-served basis. Applications for all permits may be obtained from the Clerk's office or from the Township's website.
(6) 
If the permit is damaged, the old permit must be brought to the Township Clerk's office before issuance of a replacement at a fee as set forth in Chapter 245, Fees, Rates and Charges.
(7) 
No refunds, rebates or prorated fee shall be given for any permit.
(8) 
Persons without a regular parking permit may obtain a special one-day parking permit issued by the Township Clerk's office for the lots designated in Subsection C(2). One-day permits will be issued as space allows and at a cost as set forth in Chapter 245, Fees, Rates and Charges.
(9) 
Any person who attempts to remove or tamper with parking enforcement materials shall be subject to a fine not to exceed $2,000 or imprisonment for a period not exceeding 90 days or community service for a period not exceeding 90 days, or any combination thereof.
(10) 
When a permit is lost or stolen, the Denville Police Department must be notified and a report made. Also, the permittee must file an affidavit with the Township Clerk's office. Permits may be replaced at the fee set forth in Chapter 245, Fees, Rates and Charges.

No person shall park a vehicle within the parking areas set forth in Article III in spaces designated as metered parking (by individual meter or common meter) without paying the required fee in accordance with Chapter 245, Fees, Rates and Charges, or allow a vehicle to remain parked in excess of the paid time limit.

No person shall park a vehicle within the parking areas set forth in Article III in spaces designated as time-limit parking in excess of the posted permissible time limit.

No person shall park a vehicle in the parking areas set forth in Article III in spaces designated as free daily parking in violation of § 374-15.

A. 
The Mt. Tabor Train Station Lot designated in Article III shall be operated from 9:00 a.m. to 6:00 p.m., Monday through Friday, during which period the legal parking limits shall apply.
B. 
The West Main Street Lot and the First Avenue Lot designated in Article III shall be operated from 9:00 a.m. to 6:00 p.m., Monday through Saturday, during which period the legal parking limits and/or parking meter fees as set forth in Chapter 245, Fees, Rates and Charges shall apply, provided that a vehicle that does not have a permit issued pursuant to Article II shall not park for more than three hours in the First Avenue Lot.
C. 
All off-street parking areas designated in Article III, except for posted permit parking spaces authorizing overnight parking with a valid permit in the First Avenue and Bloomfield Avenue Lots, shall be closed to any parking of any vehicle from 3:00 a.m. to 6:00 a.m. on each and every day.
D. 
Area A of the Church Street Lot (consisting of the two most southwesterly spaces) as designated on Exhibit C[1][1] shall be designated as "electric vehicle charging stations" and reserved for the exclusive use of electric vehicles. Any vehicle that is not an electric vehicle is prohibited from parking in the designated spaces.

The fact that the timing device on any parking meter is not in operation shall be presumptive evidence that the driver or owner of the vehicle then found parking in the parking space regulated by such parking meter, failed to deposit, or caused to be deposited, the required coin or coins in the meter, and the mechanical indication of such a parking meter of a "violation" shall be presumptive evidence of unlawful parking provided the driver or owner of the vehicle has not secured a parking permit as hereinabove prescribed.

It shall be unlawful and an offense for any person to permit a vehicle registered in their name to remain in any parking space while the parking meter adjacent to the parking space is displaying a signal showing that the time for which the privilege granted to park in the space has expired.

The Township and the Police Department shall have the right to remove from any off-street parking area any unattended vehicle parked or standing in an off-street parking area not designated as a parking space; any unattended vehicle parked or standing in the westernmost three aisles of the Bloomfield Avenue Lot between the hours of 3:00 a.m. to 1:00 p.m. on a Sunday; or any unattended vehicle parked or standing in a designated parking space which has remained in the designated parking space for a period of 12 hours after a summons has issued charging a violation hereunder. When a vehicle is so removed from an off-street parking area, the owner of the vehicle shall pay, before being entitled to recovery or possession of the vehicle, all reasonable charges for towing, storage and other expenses incurred in the removal of the vehicle.

Any summons issued pursuant to this chapter for a nonmoving violation may be served by affixing it to the vehicle involved in the violation.

It shall be unlawful and an offense for any person to wash, paint or repair a vehicle in an off-street parking area, provided, however, nothing herein shall be construed to prohibit necessary emergency repairs of a vehicle.

The following penalties shall apply to violations of this Article II:
A. 
Parking in unmarked space in violation of § 374-15A through F: $35.
B. 
Parking in violation of § 374-15G through I: $35.
C. 
Parking without a permit in violation of § 374-16: $35.
D. 
Parking in violation of § 374-20 or 374-22: $35.
