It is a declared policy of the Township of Sandyston that subsequent
to the passage of this chapter, with regard to criminal history and
motor vehicle records the following procedure shall in effect:
A. The Township of Sandyston shall perform a criminal history and a
driver's license record checks for all new full-time and part-time
applicants seeking employment with the Township.
B. The Township of Sandyston shall perform driver's license record
checks for all current employees who may operate Township-owned and
Township-insured vehicles and/or their own vehicle if used for Township
business.
C. The Township of Sandyston shall perform a criminal history and driver's
license record checks on all applicants of the Fire Department who
may operate Township-owned or Township-insured vehicles and/or their
own vehicle for Fire Department purposes.
D. The Township of Sandyston shall perform driver's license record
checks for all Fire Department volunteers who may operate Township-owned
and/or Township-insured vehicles and/or their own vehicle if used
for Fire Department business.
E. The Township of Sandyston shall perform a criminal history check
for all volunteers of the Recreation Commission who volunteer to coach
and/or supervise any sport or event.
F. The Township of Sandyston reserves the right to require all current
full-time employees, part-time employees and Volunteer Fire Department
members, volunteer recreation members to submit to criminal history
and driver's license history look-up at the discretion of the
Township Committee of the Township of Sandyston. Failure to submit
to these searches shall be grounds for termination and/or dismissal.
All information secured as a result of the criminal history
and driver's license record checks shall be confidential and
shall be released only to appropriate officials of the Township of
Sandyston, Sandyston Township Volunteer Fire Department or Sandyston
Township Recreation who may be involved in reviewing and acting on
information received.
All ordinances and parts of ordinances inconsistent with any
part of this chapter are hereby repealed to the extent that they are
in such conflict or inconsistent. If any section, paragraph, subparagraph,
sentence, clause, or phrase of this chapter shall be held to be invalid
by any court, such decision shall not invalidate any remaining portion
of this chapter.
This chapter may be renumbered for codification purposes.
This chapter shall take effect upon passage and publication
as soon as practicable and in the manner provided by law.
