This chapter shall be known and may be cited as the "Mobile Wireless Service Facility (MWSF) Ordinance of the Village of Mishicot (Village), Wisconsin," also known as "this chapter" herein.
The purpose of this chapter is to establish general guidelines for the locating of mobile wireless service facilities (MWSF) and their component parts, including but not limited to towers, antennas, ground equipment and related accessory structures. The purposes and intent of this chapter are to:
A.
Promote the health, safety, and general welfare of the public by regulating the locating of mobile wireless service facilities.
B.
Minimize the impacts of MWSFs on surrounding land uses by establishing standards for location, structural integrity, and compatibility.
C.
Encourage the location and collocation of MWSF equipment on existing structures, thereby minimizing new visual, aesthetic, and public safety impacts and effects upon the natural environment and wildlife, and to reduce the need for additional towers.
D.
Accommodate the growing need and demand for MWSF services.
E.
Encourage coordination between suppliers and providers of MWSF services.
F.
Establish predictable and balanced codes governing the construction and location of MWSF within the confines of permissible local regulations.
G.
Establish review procedures to ensure that applications for MWSF are reviewed and acted upon within a reasonable period of time as required by applicable state and federal regulations.
H.
Respond to the policies embodied in the Telecommunications Act of 1996, the Middle Class Tax Relief and Job Creation Act of 2012, and other applicable federal and state regulations in such a manner as not to unreasonably discriminate between providers of functionally equivalent personal wireless services or to prohibit or have the effect of prohibiting personal wireless services.
I.
Protect the character of the Village while meeting the needs of its citizens to enjoy the benefits of MWSF.
J.
Encourage the use of public lands, buildings, and structures as locations for MWSF demonstrating concealed technologies and revenue-generating methodologies.
The provisions of this chapter are adopted under authority granted by the Legislature of the State of Wisconsin with particular reference to Ch. 66, Wis. Stats.
This chapter shall be effective from and after the date of its adoption by the Village on June 21, 2016.
The provisions and requirements of this chapter supersede all the provisions and requirements of the Village's preexisting Wireless Communications Facility Ordinance adopted on February 5, 2013, and amended through June 21, 2016.
