A.
Development standards. The Village requires collocation and combining of MWSF antennas on existing towers as a higher priority than a new tower where collocation is possible. Upon enactment of this chapter, any person, corporation, partnership, or other entity which intends to engage in a Class 2 collocation on an existing tower within the jurisdiction of this chapter must obtain a permit (Level II). Class 2 collocation MWSFs (which include upgrades and modifications to existing MWSF installations) are subject to the following:
(1)
A Class 2 collocation or combined antenna or antenna array shall not exceed the maximum height prescribed in the conditional use permit (if applicable) or increase the height of an existing tower by more than 20 feet and shall not affect any tower lighting, except as provided for hereinbelow.
(2)
New MWSF antenna mounts shall be flush-mounted onto existing structures, unless it is demonstrated through radio frequency (RF) propagation analysis that flush-mounted antennas will not meet the network objectives of the desired coverage area.
(3)
The equipment cabinet shall be subject to the setback requirements of the underlying zoning district. No stacking of new equipment cabinets or equipment shelters on existing equipment cabinets or equipment shelters shall be permitted.
(4)
When a MWSF collocated or combined antenna is to be located on a nonconforming building or structure, then the existing permitted nonconforming setback shall prevail.
(5)
Applications for a Class 2 collocation as defined by § 66.0404, Wis. Stats., which are entitled to the streamlined processes described in § 66.0404, Wis. Stats., shall be approved provided they meet all the following requirements:
(a)
The proposed upgrade, modification or collocation of existing towers 200 feet or more shall not increase the overall height of the MWSF by more than 20 feet; for existing towers less than 200 feet in height, the proposed modification or collocation shall not increase the overall height of the MWSF by more than 10%.
(b)
The proposed upgrade, modification or collocation shall not increase the dimensions of the equipment compound initially approved by the Village to a total area of more than 2,500 square feet. No stacking of new equipment cabinets or equipment shelters on existing equipment cabinets or equipment shelters shall be permitted.
(c)
The proposed upgrade, modification or collocation shall comply with applicable conditions of approval, if any, applied to the initial wireless facilities and MWSF as well as any subsequently adopted amendments to such conditions of approval, as updated by any applicable modifications to ANSI EIA/TIA standards or the Wisconsin Building Code.
(d)
The proposed upgrade, modification or collocation shall not exceed the applicable weight limits for the MWSF, as demonstrated by a letter from a structural engineer licensed to practice in this state.
(e)
The proposed additional MWSF collocation and tower shall comply with all federal, state, and local safety requirements.
(6)
Applications for collocation not meeting the standards of Class 2 collocation as defined in § 66.0404, Wis. Stats., but which are entitled to streamlined processing pursuant to Section 6409 of the Middle Class Tax Relief and Job Creation Act of 2012 [47 U.S.C. § 1455(a)] shall be approved provided they meet the following requirements:
(a)
A MWSF collocation on an existing antenna-supporting structure not in a public right-of-way shall not increase the overall height of the antenna-supporting structure, antenna and/or antenna array more than 10% or 20 feet, whichever is greater. A MWSF collocation on an existing antenna-supporting structure within a public right-of-way shall not increase the overall height of the antenna-supporting structure, antenna and/or antenna array more than 10% or 10 feet, whichever is greater.
(b)
A MWSF collocation eligible under this Subsection A(6) shall not, for towers not in a public right-of-way, protrude from the antenna-supporting structure more than 20 feet or the width of the structure at the elevation of the collocation, and for towers within a public right-of-way, protrude from the antenna-supporting structure more than six feet.
(c)
Any MWSF collocation on an existing antenna-supporting structure shall meet current building code requirements (including wind loading).
(d)
A MWSF collocation shall not add more than four additional equipment cabinets or one additional equipment shelter to be eligible as a collocation under this Subsection A(6). No stacking of new equipment cabinets or equipment shelters on existing equipment cabinets or equipment shelters shall be permitted.
(e)
A MWSF collocation eligible under this Subsection A(6) shall not require excavation outside of the existing leased or owned parcel or existing easements.
(f)
A MWSF collocation eligible under this Subsection A(6) shall not defeat any existing concealment elements of the antenna-supporting structure.
B.
Application requirements.
(1)
The applicant shall provide:
(a)
A written statement of compliance with all applicable FCC rules and regulations.
(b)
A complete set of construction drawings of the proposed facility demonstrating compliance with applicable federal, state and Village building codes.
(c)
A structural analysis by a registered professional engineer that the support structure complies with applicable ANSI/EIA/TIA-222G (as amended) standards with all existing and proposed equipment.
