This local law is enacted to establish a Recreation Commission pursuant to Article 13 of the General Municipal Law. The Recreation Commission shall plan and develop the Town's recreation programs and facilities. A Recreation Commission was previously established by Resolution on August 6, 2013, pursuant to Article 13 of the General Municipal Law. This chapter supersedes that resolution and is intended to further define the role and responsibilities of the Recreation Commission.
The Town of Stockport Recreation Commission shall consist of seven Commissioners who shall be residents of the Town and shall serve at the pleasure of the Town Board for a term of seven years, and the members of such Commission first appointed shall be appointed for such terms that the term of one Commissioner shall expire annually thereafter; and their successors shall thereafter be appointed to serve terms of years which shall total in number the membership of such Commission.
The members of the Commission shall serve without pay, shall elect from their own number a Chairperson and Secretary and other necessary officers to serve for one year, and shall adopt rules of procedure for the conduct of all business within its jurisdiction.
The Town Board may, at any time, request the Commission to report at a given time or regular interval. The Commission shall report at least quarterly to the Town Board and at any other time it deems proper.
The Recreation Commission shall have all of the powers and responsibilities as provided for in Article 13 of the General Municipal Law.
The Town Board has the power and the control of the fiscal affairs and expenditures of the Recreation Commission. The Town Board must approve all contracts and payment of claims. No act taken by the Commission shall bind the Town nor shall the Commission be authorized to commit any Town monies without the prior express approval of the Town Board.
This article is intended to supersede any inconsistent provisions in the Stockport town laws.
This article shall take effect upon filing in the office of the Secretary of State in accordance with Municipal Home Rule Law § 27.
