The Board of Supervisors of Lower Frederick Township of Montgomery County hereby reenacts and confirms the creation and establishment of a Planning Commission pursuant to and under the provisions of the Pennsylvania Municipalities Planning Code, Act 247 of July 31, 1968, reenacted and amended by Act 170 of December 21, 1988, P.L. 1329 (the "MPC"). The Planning Commission shall consist of seven members, all of whom shall be residents of Lower Frederick Township of Montgomery County. The term of office of each member shall be four years, consistent with the MPC. Planning Commission members will be appointed by the Lower Frederick Board of Supervisors. In the event of vacancies, the governing body shall appoint a member to fill the unexpired term.
At the time of adoption of this amended ordinance, the names and expiration date for each of the terms of office of the members of the Planning Commission are as follows:

The Township Board of Supervisors may appoint, by resolution, up to three Township residents to serve as alternate members. Such alternate member appointments are subject to the following:
A. 
The procedures concerning alternates, including appointment and designation, shall follow those set forth in the MPC, as it may be amended from time to time.
B. 
Alternates are subject to the powers, duties and restrictions set forth in the MPC, as it may be amended from time to time.
A. 
The Planning Commission shall have all the powers, duties and restrictions as set forth in the MPC, as it may be amended from time to time.
B. 
The Planning Commission, at the request of the governing body, shall have all those powers and duties set forth in Section 209.1 of the MPC, as it may be amended from time to time.[1]

The Planning Commission may, with the consent of the governing body, accept and utilize any funds, personnel or other assistance made available by the county, the commonwealth, or the federal government, or any of their agencies, or from private sources. The governing body may enter into agreements or contracts regarding the acceptance or utilization of the funds or assistance in accordance with the governmental procedures of the municipality.
All other resolutions and ordinances or parts thereof, inconsistent herewith, are hereby repealed, but only to the extent of such conflict.
If any sentence, clause, section, or part of this article is for any reason found to be unconstitutional, illegal, or invalid, such unconstitutionality, illegality, or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections, or parts of this article. It is hereby declared as the intent of the Board of Supervisors that this article would have been adopted had such unconstitutional, illegal, or invalid sentence, clause, section, or part thereof not been included herein.
The location and numerical designation of the article sections herein may be renumbered at the discretion of General Code Publishers for purposes of codification.
This article shall become effective five days after enactment.
