This chapter shall be known and may be cited as the "Zoning Law of the Village of Central Square."
There is hereby established a comprehensive zoning plan for the Village of Central Square, New York, which plan is set forth in the text and map that constitute this chapter. This chapter is adopted for the purposes set forth in § 7-704 of Article 7 of the Village Law which, in the interest of the protection and promotion of the public health, safety and welfare, shall be deemed specifically to include the following, among others: to provide efficient and adequate provision for public facilities and services; to provide reasonable privacy for families; to prevent and reduce traffic congestion, including provision for and control of parking; to protect residential areas by, among other means, the control of visual intrusion of nonresidential uses upon said residential areas; to enhance the appearance of the Village as a whole; and to encourage flexibility in the design and development of land so as to promote its most appropriate use, facilitate the adequate and economic provision of streets and utilities, preserve the natural and scenic qualities of open land and enhance and protect the environmental quality of the Village.
A. 
Generally. Words used in the present tense include the future, the singular number includes the plural, and the plural the singular. The word "person" includes a corporation as well as an individual. The word "lot" includes the word "plot." The term "occupied" or "used" as applied to any building shall be construed as though followed by the words "or intended, arranged or designed to be occupied or used." The word "shall" is mandatory and not discretionary.
B. 
Specific terms. For the purposes of this chapter, the following terms shall have the following meanings:
ABANDONED
The lawful use of any structure or land having ceased for a period of 12 consecutive months or longer shall be deemed "abandoned."
ACCESSORY BUILDING
A subordinate structure located on the same lot with the principal structure, occupied by or devoted to an accessory use. Where an accessory structure is attached to the principal structure in a substantial manner, as by a wall or roof, such accessory structure shall be considered part of the principal structure. Examples include but are not limited to the following: greenhouses; private detached garages; sheds and other storage buildings; pole barns; carports and swimming pools. Further, an accessory structure shall meet the following conditions: a building originally constructed for its intended use and for purposes of this chapter, cargo containers, railroad cars, truck vans, converted mobile homes, trailers, recreational vehicles, bus bodies, vehicles and similar prefabricated items and structures originally built for purposes other than the fixed storage of goods and materials are not accessory structures.
ACCESSORY USE
A use of land or of a building or portion thereof customarily incidental and subordinate to the main use or building and located on the same lot therewith. In no case shall such accessory use dominate an area, extent or purpose of the principal lawful use or building.
ALLEY
Any public way or thoroughfare more than 10 feet, but less than 16 feet, in width, which has been dedicated to the public for public use.
ALTERATION
Any change, addition or modification in construction, except as may be required by the Uniform Code, or any change in occupancy or use.
AREA OF A BUILDING
The sum of horizontal areas of the several floors of a building and its accessory buildings on the same lot, excluding cellar and basement floor areas not devoted to residential use but including the area of roofed porches and roof overhangs. All dimensions shall be measured between the exterior face of walls or from the center line of a dividing wall or party wall.
ARTERIAL ROAD
Those streets which are used primarily for higher speeds and high volumes of through traffic.
AUTO COURT
A building or a group of two or more detached or semidetached buildings containing rooms or dwelling units designed primarily for transient automobile travelers and providing for accessory off-street parking facilities. The term includes buildings designated as tourist courts, motor lodges, motels and similar appellations.
AUTOMOBILE GASOLINE SALES FACILITY
Any area of land, including structures thereon, or any building or part thereof that is used for the sale of gasoline or other fuels and other motor vehicle accessories and which may or may not include facilities for washing, lubricating or otherwise servicing motor vehicles, and may include accessory food sales, however not including motor vehicle maintenance and repair.
AUTOMOBILE SALES FACILITY
Any area of land, including structures thereon, that is used for the retail sale of motor vehicles and accessories and which may or may not include facilities for lubrication, washing or otherwise servicing motor vehicles, but not including the painting thereof except where specifically authorized during site plan review.
BAKERY, COMMERCIAL/WHOLESALE
An establishment engaged in the preparation and production of baked goods for transport and sale off site. The limited retail sale of baked goods may occur as an incidental or accessory use.
BED-AND-BREAKFAST ESTABLISHMENT
An owner-occupied residence resulting from a conversion of a one-family dwelling, used for providing overnight accommodations and a morning meal to not more than 10 transient lodgers, and containing not more than five guest rooms for such lodgers. The period of accommodation shall be of a clearly temporary nature. A bed-and-breakfast shall not be used as a rooming or boarding house.
BOARDINGHOUSE or ROOMING HOUSE
A lodging house or other building or structure maintained, advertised or held out to the public as a place where sleeping or rooming accommodations are furnished to the whole or any part of the public, whether with or without meals. Such places which provide sleeping and living accommodations to five or more persons unrelated to the operator and not a bed-and-breakfast facility and generally not intended as transient in nature.
BUILDING
A structure wholly or partially enclosed within exterior walls, or within exterior and party walls, and a roof, affording shelter to persons, animals or property.
BUILDING HEIGHT
The vertical distance above the average existing grade measured to the highest point of the building. The height of a stepped or terraced building shall be the maximum height of any segment of the building.
CLUB
A building or use catering exclusively to club members and their guests for fraternal and/or recreational purposes, but not primarily for profit. This definition includes lodges as defined herein. This includes but is not limited to YMCA, YWCA, YMHA, fraternity, sorority, lodges, religious and similar clubs which may or may not have dormitory accommodations.
COMPREHENSIVE PLAN
The Comprehensive Plan for the Village of Central Square, approved by the Board of Trustees, as amended or replaced by action of the Board of Trustees from time to time, which sets for the purpose, policies and programs for the development of the Village.
DAY-CARE CENTER
A facility providing supervised care, preschool, and/or activities outside a family home to three or more individuals for more than three hours a day. Any facility providing day care for three or more children must be licensed by the New York State Office of Children and Family Services.
DAY-CARE HOME
A program providing day care to no more than the maximum number of individuals allowed under the New York State Social Services Law in a family home occupied as a residence. Any day care program to which this definition does not apply in every respect shall be considered a day-care center. Any facility providing day care for three or more children must be licensed by or registered with the New York State Office of Children and Family Services
DENSITY
The number of dwelling units that are allowed on an area of land, which area of land shall be permitted to include dedicated streets contained within the development.
DRIVE-IN FACILITY
A commercial use which permits customers or patrons to purchase goods or services and conduct other business while remaining in their motor vehicles. Drive-in facilities must be developed and used in conjunction with a bank, branch bank office, restaurant, pharmacy, or car wash upon the same lot.
DRIVEWAY
A surface area providing vehicular access between a street and an off-street parking area or parking structure (i.e., garage or carport).
DUMP
A lot or land or part thereof used primarily for the disposal, by abandonment, dumping, burial, burning or any other means and for whatever purpose, of garbage, sewage, trash, refuse, junk, discarded machinery, vehicles or part thereof, or waste material of any kind.
DWELLING UNIT
A dwelling or portion thereof providing complete living, sleeping, eating and sanitary facilities for one family.
DWELLING, MULTIPLE
Any of the following:
(1) 
A building designed or occupied for residential purposes by more than two families;
(2) 
A series of attached, detached, or semidetached buildings which are provided as a group collectively with essential services and utilities and which are located on a lot, plot, or parcel of land under common ownership; or
(3) 
The residential part of a mixed-occupancy building.
DWELLING, ONE-FAMILY
A detached building designed for or occupied as a single dwelling unit.
DWELLING, TOWNHOUSE
A residential building consisting of a series of noncommunicating, individually owned one-family units having a common party wall between each unit, with private outside entrance, separate front and rear yards, and separate utility services, and located on a separate recorded lot.
DWELLING, TWO-FAMILY
A building designed or arranged to be occupied by two families living independently, with the structure having two separate dwelling units.
EASEMENT
That portion of land or property reserved for present or future use by a person or agency other than the legal fee owner(s) of the property. The easement shall be permitted to be for use under, on or above said lot or lots.
FAMILY
One or more persons occupying a dwelling unit and living as a single, nonprofit housekeeping unit.
FUNERAL HOME
An establishment with facilities for the preparation of the deceased for burial or cremation, for the viewing of the body and for the observances held for the deceased as an incident to burial or cremation.
GARAGE, PRIVATE
An accessory building not operated for gain and used in conjunction with a principal building which provides for the storage of motor vehicles and/or other household items by the occupants of the principal structure.
GARAGE, PUBLIC
A building or portion thereof, other than a private garage, and which is used for parking or storage of motor vehicles for commercial purposes.
GRADE (ADJACENT GROUND ELEVATION)
The lowest point of elevation of the existing surface of the ground, within the area between the building and a line five feet from the building.
GROSS FLOOR AREA
The sum of the horizontal areas of floors of a building measured from the exterior face of exterior walls or, if appropriate, from the center line of dividing or party walls; this includes courts and decks or porches when covered by a roof.
HOME OCCUPATION
An accessory occupation, profession, or activity conducted entirely within a dwelling unit by the inhabitants thereof; such use is incidental and secondary to the residential use of the dwelling. Home occupations include art studios, music instruction, dressmaking, and professional office of duly licensed doctors, dentist, lawyers, engineers, architects, accountants, salesperson, real estate agents, insurance agents, and similar activities; but exclude such things as barbershop, beauty parlor, pet grooming, animal hospital, or retail stores. Any aggrieved person shall apply to the Zoning Board of Appeals for an interpretation as to whether a proposed activity or use constitutes a permissible home occupation. It is the intent of this chapter that the home occupation shall only be an accessory use and that the residential character of the neighborhood involved shall be maintained.
HOTEL
A building in which lodging is provided and offered to the public, which is customarily open to transient guests, and which may include ancillary facilities and services such as restaurants, meeting rooms, entertainment, personal services, and recreational facilities. A hotel unit may contain a kitchen for extended stay lodgings. Outdoor athletic courts and other outdoor facilities are permitted and may be included with a hotel use.
INCIDENTAL
Subordinate and minor in significance and bearing a reasonable relationship with the principal use.
JUNKYARD
A lot, land or structure, or part thereof, used primarily for the collecting, storage and sale of wastepaper, rags, scrap metal or discarded material or for the collecting, dismantling, storage and salvaging of machinery or vehicles not in running condition, and for the sale of parts thereof.
KENNEL
An establishment licensed to operate a facility housing cats, dogs or other household pets and where grooming, breeding, boarding, training or selling of animals is conducted as a business.
LAND USE ACTIVITY
Any construction or other activity which changes the use or appearance of land or a structure or the intensity of use of land or a structure. "Land use activity" shall explicitly include, but shall not be limited to, the following: new structures, expansions to existing structures, new uses, changes in or expansions to existing uses, roads, driveways, and excavations for the purpose of extracting soil or mineral deposits.
LANDSCAPING
The finishing and adornment of unpaved yard areas. Materials and treatment generally include naturally growing elements such as grass, trees, shrubs and flowers. This treatment shall be permitted also to include the use of logs, rocks, fountains, water features and contouring of the earth.
LAUNDRY AND DRY-CLEANING ESTABLISHMENT (COMMERCIAL)
A business premises equipped with large-scale clothes washing and dry-cleaning equipment.
LAUNDRY AND DRY-CLEANING ESTABLISHMENT (PERSONAL)
A business premises equipped with individual clothes-washing equipment for the use of retail customers or the drop off and pick up of clothing for dry cleaning by retail customers.
LIBRARY
A place in which literary, musical, artistic or reference material (such as books, manuscripts, recordings or films) are kept for use by the public and may include meeting or lecture rooms, but shall exclude businesses which rent or sell books, records, videotapes, videodiscs, or similar objects for compensation or profit.
LODGE
A structure used for meetings and activities by social, service or community organization. Examples include, but are not limited to, Elks, VFW, American Legion, Kiwanis, Junior League, Masonic Lodge, Rotary and University Club.
LODGING HOUSE
See "boardinghouse."
LOT
Land occupied or to be occupied by a building and its accessory buildings, or by a dwelling group and its accessory buildings, together with such open spaces as are required under the provisions of this chapter, having not less than the minimum area and width required by this chapter for a lot in the district in which such land is situated, and having its principal frontage on a street or on such other means of access as may be determined in accordance with the provisions of law to be adequate as a condition of the issuance of a building permit for a building on such land.
(1) 
CORNER LOTA lot of which at least two adjacent sides front their full lengths upon streets.
(2) 
INTERIOR LOTA lot other than a corner lot.
(3) 
THROUGH LOTAn interior lot which runs through a block from street to street.
LOT DEPTH
The average horizontal distance between the front and rear lot lines.
LOT LINES
The property lines bounding the lot. In the case of a lot fronting on more than one street the owner may elect any street lot line as the front lot line. The rear line shall be the lot line most distant from the front lot line.
LOT WIDTH
The least horizontal distance across the lot between side lot lines, measured at the front of a principal structure erected or to be erected on such lot at a distance from the front line equal to the required depth of front yard.
MANUFACTURED HOME
A dwelling unit manufactured in one or more sections; designed for long-term occupancy; containing sleeping accommodations, a flush toilet, a tub or shower bath, and kitchen facilities, with plumbing and electrical connections provided for attachment to outside systems; designed to be transported after fabrication on its own wheels, or on a flatbed or other trailer; and arriving at the site where it is to be occupied as a dwelling complete and bearing a seal issued by the Federal Department of Housing and Urban Development.
MANUFACTURED HOME PARK
A parcel of land which has been planned and improved primarily for the placement of mobile manufactured homes.
MANUFACTURED HOME PARK, SENIOR CITIZENS
A manufactured home park where tenants and occupants of manufactured homes are restricted to persons over 55 years of age, except that one family member may be less than 55 years of age but not less than 50 years of age, provided further that a handicapped person entitled to social security benefits as permanently disabled may occupy a manufactured home therein regardless of age.
MODULAR HOME
A structure designed primarily for residential occupancy, constructed by a method or system of construction whereby the structure or its components are wholly or in substantial part manufactured in manufacturing facilities, intended or designed for permanent installation, or assembly and permanent installation, on a building site and in compliance with applicable provisions of the Uniform Code.
MOTOR VEHICLE MAINTENANCE AND REPAIR
A facility used or intended to be used primarily for major repairing and/or painting of motor vehicles and which is not used or designed to be used for the sale of gasoline, oil or other motor vehicle fuels to the public.
NONCONFORMING BUILDING
A building which in its design or location upon a lot does not conform to the regulations of this chapter for the district in which it is located.
NONCONFORMING USE
The use of land, premises, building or structure legally existing at the time of the effective date of the ordinance from which this chapter was derived which fails to comply with the regulations set forth in this chapter applicable to the district in which such use is located.
NURSING HOME
A facility regulated by the state, other than a hospital, where persons except insane, mental cases, inebriated or contagious patients are provided lodging, board and continuing nursing care for compensation to convalescent, infirm, incapacitated or chronically ill, dementia or Alzheimer's persons. The term "nursing home" shall include convalescent home, rest home, and long-term care facility.
OFFICE
A use that involves administrative, clerical, financial, governmental or professional operations and operations of a similar character. This use shall not include retail or industrial uses, but may include business offices, medical offices, laboratories, photographic studios and/or television or radio broadcasting studios.
OPEN SPACE
An unoccupied space open to the sky.
PARKING SPACE
An off-street space available for the parking of one motor vehicle and having a dimension of 10 feet by 20 feet, exclusive of passageways and driveways appurtenant thereto and giving access thereto and having direct access to a street or alley.
PARTY WALL
A common shared wall between two separate structures, buildings, or dwelling units.
PERSONAL SERVICE
Establishments for the on-site provision of retail services to customers which may include the incidental sale of products. Such establishments shall include but not be limited to the following: clothing repair, dry cleaners, shoe repair, barbershops and beauty shops, laundry/laundromats, small appliance repair, jewelry and watch repair, photographic studio, arts and craft instruction and travel agencies. The following uses are specifically excluded from this definition: retail trade, theaters, hotel/motel, commercial and business schools, private clubs and professional and business offices.
PLANNED UNIT DEVELOPMENT (PUD)
A residential, commercial or industrial development guided by a total design plan in which one or more of the zoning or subdivision regulations, other than use regulations, specified in the design plan shall be permitted to be waived or varied to allow flexibility and creativity in site and building design and location, in accordance with general guidelines.
PORTABLE GARAGE
Structures utilized on a short-term, seasonal or intermittent basis, such as tents, canopies, portable sheds, portable garages or similar structures, made of vinyl, canvas, or tarp fitted over a sturdy frame of pipe (aluminum, steel, PVC, or similar material) which is anchored to the ground without a permanent foundation, however excluding children's play tents and other seasonal canopies not used for storage.
PRINCIPAL STRUCTURE
A building in which the principal use of the site is contained, including any buildings which are attached to the principal structure by a covered structure.
PRIVATE SCHOOL
A school establishment to provide for the teaching of industrial, clerical, managerial or artistic skills. This definition applies to schools that are owned and operated privately for profit and that do not offer a complete educational curriculum (e.g., beauty school, modeling school, etc.).
PROFESSIONAL OFFICES
An office of a member of a recognized profession maintained for the conduct of that profession and not including storage or sale of merchandise as a primary use. Included but are not limited to offices for real estate, stock and bond brokers, accountants, adjusters, appraisers, utility companies, physicians, lawyers, clergymen, teachers, dentists, architects, engineers, insurance agents, opticians, banks, financial institutions, contractors (excluding storage) and similar office-oriented uses.
PROFESSIONAL RESIDENT-OFFICE
An office in a residence used exclusively by the owner/occupier for the provision of personal services in the following categories: physician, dentist, architect, lawyer, engineer, artist, musician, certified public accountant. For the purpose of these regulations, such an office shall be considered a home occupation.
PUBLIC UTILITY STRUCTURE
A structure or facility used by a public or quasi-public utility agency to store, distribute, generate electricity, gas, telecommunications, and related equipment, or to pump or chemically treated water or sewage. This does not include storage or treatment of hazardous waste.
RECREATION CENTER
A building, open to the public, where meetings may be held, and recreational facilities are available for a fee.
RECREATION, INDOOR
An establishment providing completely enclosed recreation activities. Accessory uses shall be permitted to include the preparation and serving of food and/or the sale of equipment related to the enclosed uses. Included in this definition shall be bowling, roller skating or ice skating, billiards, pool, motion-picture theatres, and related amusements.
RECREATION, OUTDOOR
An area free of buildings except for restrooms, dressing rooms, equipment storage, maintenance buildings, open-air pavilions and similar structures used primarily for recreational activities.
RECREATIONAL VEHICLE
A vehicular-type unit primarily designed as temporary living quarters for recreational, camping or travel use which either has its own motive power or is mounted on or drawn by another vehicle. The basic entities are:
(1) 
TRAVEL TRAILERA vehicular portable unit, mounted on wheels, of such a size or weight as not to require special highway movement permits when drawn by a motorized vehicle and a body width of no more than eight feet and a body length of no more than 40 feet when factory equipped for the road.
(2) 
CAMPING TRAILERA vehicular portable unit mounted on wheels and constructed with collapsible partial side walls which fold for towing by another vehicle.
(3) 
TRUCK CAMPERA portable unit designed to be loaded onto or affixed to the bed or chassis of a truck. Truck campers are of two basic types:
(a) 
SLIDE-IN CAMPERA portable unit designed to be loaded onto and unloaded from the bed of a pickup truck.
(b) 
CHASSIS-MOUNT CAMPERA portable unit designed to be a fixed to a truck chassis.
(4) 
MOTOR HOMEA vehicular unit built on a self-propelled motor vehicle chassis.
REGISTERED DESIGN PROFESSIONAL
An individual registered or licensed to practice professional architecture or engineering as defined by the Education Law of the State of New York.
RELIGIOUS FACILITY
Includes churches, temples, parish houses, convents, seminary and retreat houses.
RESTAURANT
A commercial use consisting of the preparation, sale and service of food and beverages primarily for consumption on the premises, but not excluding takeout service. Sale of beverages may include alcoholic beverages as a secondary activity. Restaurants with drive-in facilities shall be included in the "drive-in facility" definition.
RETAIL BUSINESS
Establishments conducting the sale of goods to the public. Retail business shall include variety stores, apparel stores, florists, drugstores, grocery stores, establishments, liquor stores, antique shops, music shops, sporting goods stores, book, stationary, magazines, candy and tobacco shops, and other similar business outlets that sell merchandise on a retail basis, but excluding eating and drinking establishments, automotive sales, or automobile gasoline sales facilities.
ROOF, SIGN
A sign which is erected, constructed or maintained on, above, or as part of the roof of any building, but which shall not extend above the roofline of the building upon which it sits.
ROOMING HOUSE
See "boardinghouse."
SERVICE BUSINESS
A facility established and operated to provide for the broader or more specialized service needs of a larger population base and drawing market support from the surrounding region, including but not limited to commercially operated schools of beauty culture, business, dancing, driving, music and similar establishments.
SIGN
Any material, structure or device, or part thereof, composed of lettered or pictorial matter which is located out-of-doors, or on the exterior of any building displaying an advertisement, announcement, notice or name, and shall include any declaration, demonstration, display, representation, illustration or insignia used to advertise or promote the interests of any person or business or cause when such is placed in view of the general public. The word "sign" includes the word "billboard," but does not include the flag, pennant or insignia of any municipal unit, or of any political, educational, charitable, philanthropic, civic, professional, religious or like campaign, drive, movement or event.
SIGN DIRECTORY
A listing of two or more business enterprises, consisting of a matrix and sign components.
SIGN FACE
One side of any sign or signs, which face in the same direction, are mounted as a freestanding sign and relate to the same business.
SIGN, ABANDONED
A sign that, for 60 days or longer, no longer identifies or advertises an ongoing business, product, location, service, idea, or activity conducted on the premises on which the sign is located.
SIGN, AWNING
Any visual message incorporated into an awning attached to a building.
SIGN, BANNER
A temporary advertisement displayed for the occasion of a special event, made of fabric or other nonrigid material with no enclosing framework.
SIGN, BILLBOARD
Any sign which directs attention to a business, commodity, service, entertainment, or attraction, sold, offered, or existing at a property other than upon the same lot where such sign is displayed, or only incidentally upon such lot.
SIGN, CHANGEABLE COPY
A sign on which the visual message may be periodically changed.
SIGN, DIRECTIONAL
A sign limited to providing information on the location of an activity, public facility or event.
SIGN, ELECTRONIC MESSAGE
An electrically activated changeable copy sign whose variable message capability can be electronically or digitally programmed.
SIGN, FOOTCANDLE
A unit for measuring illumination. It is equal to the amount of direct light thrown by one candle on a square foot of surface every part of which is one foot away.
SIGN, FREESTANDING
Any sign not attached or part of any building but separate and permanently affixed by any other means in or upon the ground. Included are pole signs, pylon signs and masonry wall-type signs.
SIGN, ILLUMINATED
Any sign illuminated by electricity, gas or other artificial light either from the interior or exterior of the sign, and which includes reflective and phosphorescent light.
SIGN, PORTABLE
A sign, whether on its own trailer, wheels, or otherwise, designed to be movable and not structurally attached to the ground, building, structure or other sign.
SIGN, PROJECTING
A sign which is attached to the building wall or structure and which extends horizontally more than 15 inches from the plane of such wall, or a sign which is perpendicular to the face of such wall or structure.
SIGN, REAL ESTATE
A temporary sign advertising the sale, lease, or rental of the property or premises upon which it is located.
SIGN, REPRESENTATIONAL
A three-dimensional sign built so as to physically represent the object advertised.
SIGN, TEMPORARY
A sign related to a single activity or event having a duration of no more than 30 days, which shall include, but not be limited to, portable signs, political signs, real estate signs, construction signs, private information signs such as garage sales, banners, inflatable signs, airborne signs, and special event signs.
SIGN, WALL
A sign which is painted on or attached to the outside wall of a building with the face of the sign in the plane parallel to such wall, and not extending more than 15 inches from the face of such wall.
SIGN, WINDOW
A sign, picture, symbol or combination thereof, designed to communicate information about an activity, business, commodity, event, sale or service, that is placed upon a window pane or glass and is visible from the exterior of the window.
SIGN-NIT
A photometric unit of measurement referring to luminance. One nit is equal to one cd/rn2.
STREET
A public or private thoroughfare which affords the principal means of access to adjoining premises.
STRUCTURE
Anything constructed or erected, the use of which requires location on the ground or attachment to something having location on the ground. The term "structure" includes the term "building."
SWIMMING POOL
Any structure that contains, or is capable of containing, water over 24 inches in depth and which is used, or intended to be used, for swimming or recreational bathing. This includes in-ground, aboveground or on-ground swimming pools, hot tubs and spas.
THEATER
A building used primarily for the presentation of live stage productions, performances or motion pictures.
TOURIST CAMP
Any lot, piece or parcel of ground on which are located, or which is offered to the public for the location of, two or more tents, tent houses, cabins, camp cottages or other buildings designed for or used for sleeping facilities other than permanent houses.
TOURIST HOUSE
A dwelling in which overnight accommodations are provided or offered for transient guests for compensation, which use is secondary to the use as a single-family dwelling. A bed-and-breakfast shall also be considered a tourist home.
TRANSIENT
Housing or accommodations which are typically occupied by residents for periods of two weeks or less, including, but not limited to, hotels, motels, tourist houses, bed-and-breakfast and travel lodges.
TRAVEL TRAILER PARK
Any lot, piece or parcel of land on which are located, or which is offered to the public for the location of, two or more travel trailers or other recreational vehicles as defined in this section and/or tents for transient use for camping or sleeping purposes.
UNIFORM CODE
The Uniform Code Fire Prevention and Building Code promulgated by the New York State Department of State, as last amended.
USE
The specific purpose for which a building, or parcel of land, is designed, arranged, or intended or for which it is or may be occupied or maintained. The term "permitted use" or its equivalent shall not be deemed to include any nonconforming use.

Chapter 64 of the Consolidated Laws of the State of New York.
WAREHOUSE, WHOLESALE OR STORAGE
A building or premises in which goods, merchandise or equipment are stored for eventual distribution.
YARD
An unoccupied space open to the sky, on the same lot with a building or structure.
YARD, FRONT
An open, unoccupied space on the same lot with the building between the front line of the building and the front line of the lot measured from the right-of-way of the street and extending the full width of the lot.
YARD, REAR
An open, unoccupied space on the same lot with the principal structure between the rear line of the principal structure and the rear line of the lot and extending the full width of the lot; provided, however, that, notwithstanding the foregoing, an accessory building or structure of not more than 10 feet wide by not more than 20 feet in length may be located in the rear yard. Also, an above- or below-ground swimming pool may be located in the rear yard but not less than 10 feet from the rear or side line of the lot.
YARD, SIDE
An open, unoccupied space on the same lot with the building situated between the building and the side line of the lot and extending from the front yard to the rear yard. Any lot line not a rear line or a front line shall be deemed a side line.

Other words. Other words not otherwise specifically defined in this section shall have the meanings ascribed to them in the Uniform Code. If not defined in the Uniform Code or this chapter, then they shall be given the usual and ordinary meaning unless the context or subject matter otherwise requires a technical or special meaning.
