As used in this chapter, the following terms shall have the meanings indicated:
AIRCRAFT
Includes airplanes, helicopters, gliders, ultra-light aircraft, all heavier than air aircraft, as well as lighter than air aircraft.
No person shall pilot any aircraft at an altitude of less than 1,000 feet over the Township of Reserve, or any part thereof, except in an emergency, or for taking off and landing at a landing facility which has been licensed and approved by the proper authorities of the United States Government and/or the government of the Commonwealth of Pennsylvania, and/or the Township of Reserve.
Helicopters and ultra-light aircraft shall be permitted to make landings, other than at landing facilities referred to in § 142-2 of this chapter, and emergency landings, only in areas within a commercial district as defined in the Township of Reserve Zoning Ordinance and as designated on the Zoning Map of the Township, when permission of the property owner is granted, written permission of the Township Manager has been obtained, and such landings are made with proper regard to safe practices.
Helicopters and ultra-light aircraft may procure special permission to make landings other than at facilities referred to in § 142-2 of this chapter for educational and public purposes when adequate safety precautions have been made in advance which shall be specifically approved in writing by the Township Manager or the Chief of Police, the landing is made under strict police supervision and written permission of the property owner is granted. The term for educational and public purposes as used herein, is defined as an undertaking for the intellectual improvement and cultivation of the mind for which the community at large has some interest.

This chapter shall be enforced by a criminal action in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure. Any person, partnership, corporation or other entity who or which violates or permits a violation of the provisions of this chapter shall, upon conviction in a summary proceeding, pay a fine of not more than $1,000, plus the costs of prosecution, and in default of the payment of the fine and costs of prosecution, shall be imprisoned for a period not exceeding 90 days. Each day, or part thereof, that a violation continues shall constitute a separate violation.
All ordinances or parts of ordinances conflicting herewith be and the same are hereby repealed insofar as they conflict herewith.
