This article shall be known as the "Buffalo Township Portable Storage Unit Ordinance of 2021."
The purpose of this article is to provide regulations as to the number, size, location and time of use of portable storage units.
The following words and phrases, unless the context clearly indicates otherwise, shall have the meanings given in this article:
PORTABLE STORAGE UNIT
A container that is not affixed to the land and that is designed for temporary short-term storage.
STRUCTURE
Any assembled, erected or constructed object having a stationary location on or in land or in water, whether or not affixed to the land, including, but not limited to, storage sheds, storage containers, portable storage units, communications equipment buildings, communications towers and similar objects.
The following regulations shall be applicable to portable storage units for on-site storage:
A. 
There shall be no more than one portable storage unit per lot at any given time.
B. 
A portable storage unit shall be no larger than eight feet wide, 40 feet long and eight feet high.
C. 
No portable storage unit shall remain on a parcel of land located in Buffalo Township in excess of six consecutive months in any calendar year. A person/entity can request an extension, in writing, up to an additional six months which will need written approval by the Township. The Township may allow for an additional extension(s) and may set the appropriate fee for any permits/extensions by resolution. A portable storage unit shall be removed from the lot by the expiration date on the permit.
D. 
A portable storage unit shall be permitted during construction, reconstruction, alteration or renovation of the principal building and for an additional period of three days before and after such activity, provided a building permit has been issued by Buffalo Township. The portable storage unit shall be removed from the lot before the Township Building Inspector issues an occupancy permit or if the construction activity ceases for a period of more than seven consecutive days.
E. 
A portable storage unit may be located on a lot during an emergency situation as declared by the appropriate federal, state, county or Township agency pursuant to a temporary permit issued by the Buffalo Township Zoning Officer. The portable storage unit shall be removed from the lot within seven days after the end of the emergency declaration.
A. 
It shall be unlawful for any person to place, or permit the placement of, a portable storage unit on property which he or she owns, rents, occupies or controls without first having obtained a permit therefor from the Buffalo Township Zoning Officer.
B. 
Application for a permit shall be made to the Buffalo Township Zoning Officer on a form provided by the Township. The Zoning Officer shall determine the most appropriate location for the portable storage unit to be placed on the lot. A permit fee in the initial amount of $100 is hereby established for six consecutive months. A fee of $25 per each thirty-day extension thereafter shall be charged until the portable storage unit is removed. This fee may be amended from time to time by resolution of Buffalo Township and shall accompany the application. The issuance of a permit shall allow the applicant to place the portable storage unit on the subject lot in the location specified in the permit in conformance with the requirements of this article. The permit shall be posted in plain view on the subject lot.
Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $600; and/or to imprisonment for a term not to exceed 90 days. Every day that a violation of this article continues shall constitute a separate offense.
In the event that any provision, section, sentence or portion of this article shall be held invalid, such invalidity shall not affect or impair any of the remaining provisions of this article, as the provisions are severable and would have been enacted had not such invalid provision been included herein.
All ordinances or parts of ordinances that are inconsistent herewith are hereby repealed.
This article shall take effect as set forth in the Second Class Township Code.[1]
