The Board of Supervisors of the Township of Barrett hereby signifies its intention and desire to organize an Authority under the provisions of the "Municipality Authorities Act of 1945" (Act of May 2, 1945, P.L. 382), as amended.[1]

The Chairman, a member, and the Secretary of the Board of Supervisors are hereby authorized and directed to execute, on behalf of the Township of Barrett, Articles of Incorporation in substantially the following form:
ARTICLES OF INCORPORATION
TO THE SECRETARY OF THE COMMONWEALTH OF PENNSYLVANIA:
In compliance with the requirements of the Act of May 2, 1945, P.L. 382, known as the "Municipality Authorities Act of 1945," as amended, the municipal authorities of the Township of Barrett, Monroe County, Pennsylvania, desiring to incorporate an Authority thereunder, do hereby certify:
(a)
The name of the Authority is "Barrett Township Municipal Authority."
(b)
Said Authority is formed under the provisions of the Act of May 2, 1945, P.L. 382, known as the "Municipality Authorities Act of 1945," as amended.
(c)
No other authority has been organized under the said Municipality Authorities Act of 1945, or under the Act approved the 26th day of June, 1935, P.L. 463, or is in existence in or for the Township of Barrett, Monroe County, Pennsylvania.
(d)
The name of the incorporating municipality is the Township of Barrett, Monroe County, Pennsylvania, and the names and addresses of its municipal authorities are as follows:

Whose terms of office shall commence on the date of appointment and shall be computed from January 1, 1958.

Said Authority is organized for all of the purposes set forth in the Municipality Authorities Act of 1945, as amended, and shall have all of the powers granted in said Act.
The first members of the Board of Supervisors of Barrett Township Municipal Authority named in the proposed Articles of Incorporation are hereby specifically appointed members of said Board for the terms of office set after their respective names, which terms shall commence on the date of approval hereof and shall be computed from January 1, 1958.
The proper officers of the Township are hereby directed to cause a notice of this chapter to be published one time in the Monroe Legal Reporter, the legal periodical of Monroe County, and one time in the Daily Record, a newspaper published and of general circulation in Monroe County, as required by the Municipality Authorities Act of 1945, as amended;[1] to file said Articles of Incorporation, together with the required proofs of publication of notice of this chapter and a certified copy of this chapter with the Secretary of the Commonwealth; and to do, execute and perform any and all official acts, and to pay all fees and costs necessary or appropriate to effect the incorporation of Barrett Township Municipal Authority.

Said Authority shall be for all of the purposes set forth in the Municipality Authorities Act of 1945, as amended, and shall have all of the powers granted in said Act.
The first project to be undertaken by the Authority shall be to acquire, hold, construct, improve, maintain, operate, own and lease, either as lessor or lessee, sewers, sewer systems, sewage treatment works and property and equipment for use in connection therewith for the Township of Barrett and for such other territory as it may be authorized to serve. The second project to be undertaken by the Authority shall be to acquire, hold, construct, improve, maintain, operate, own and lease, either as lessor or lessee, water sheds, impounding reservoirs, purification systems, pumping facilities, pipelines, distribution systems, rights-of-way, and all other real or personal property necessary or convenient for use in connection with such sewer systems for the Township of Barrett and for such other territory that may be authorized to serve. Said Authority shall not undertake any other project or projects unless specifically authorized by ordinance of the Board of Supervisors of the Township of Barrett.
All ordinances and parts of ordinances, resolutions and parts of resolutions inconsistent herewith are hereby expressly repealed.
This chapter shall take effect immediately upon final enactment.
