The City of Belfast hereby adopts this article in order to regulate
conduct on all City property, rights-of-way, range ways, and City-owned
easements. Different chapters, articles and sections address a multitude
of specific and general subjects that are all incorporated City Code
of Ordinances. The purpose of this article is to identify a common
set of prohibitions and fines that apply to all City-owned property
and to wherever the City has property rights. At worst, this section
will duplicate some of the existing regulations in the Code of Ordinances
that are already stated. Rather than some rules applying to some City
property, the rules in the article apply to all City property.

This article is enacted pursuant to the home rule authority
granted to the City in accordance with the provisions of 30-A M.R.S.A.
§ 3001.

For the purpose of this article, "City property" means all City
real and personal property and property rights. This includes, but
is not limited to, City parks, City land, City buildings, parking
lots, sidewalks and roads and rights-of-way, easements, range ways,
facilities, etc.

Upon written application, the City council may by order vary
or suspend the operation of any section of this article for a specified
period of time if the applicant establishes that:
(a) The proposed activity will not unreasonably interfere with or detract
from the general public enjoyment of public property.
(b) The proposed activity or use will not unreasonably interfere with
or detract from the promotion of public health, welfare, safety and
recreation.
(c) The proposed activity will not entail unusual, extraordinary or burdensome
expense or police operation by the City.
