The City of Collinsville Drug and Alcohol Testing Procedures Policy, attached hereto as Exhibit 2, is hereby adopted and made part of this article.[1]

All parts of any ordinance in conflict with the provisions of this article are to the extent of such conflict hereby repealed.
If any provision of this article shall be held to be invalid or unconstitutional, the remainder of such ordinance shall continue in full force and effect the same as if such invalid or unconstitutional provision had never been a part hereof.
This article shall be effective as of January 11, 1994.

The City Council having reviewed and studied reports of the misuse of equipment, tractors, trucks and backhoes owned by the City of Collinsville for utility maintenance work in behalf of the City of Collinsville, have been permitted to be used by public officials or public employees or said public officials or public employees allowing persons not employed by the City of Collinsville to utilize the said equipment on their private properties thereby obtaining the benefits or enrichment of the said individuals misuse of the said equipment owned by the City of Collinsville in violation of Section 39.01 and Section 39.02 of the Vernon's Texas Penal Code Annotated and for the reason of violation of the said Penal Code herein quoted by the misuse and misappropriation of said public property, said individual or individuals violating the said Penal Code shall be subject to fine as provided for in Section 39.02 of the said Penal Code.
The City attorney of Collinsville may be authorized to file a charge of violation either in the Municipal Court of Collinsville or with the State or the County Court at Law or the District Court of Grayson County in accordance to the violation as set forth in Section 39.02 of the Texas Penal Code. Should a unanimous vote of the City Council of Collinsville not authorize the filing of said charge, a majority vote of the City Council of Collinsville may authorize the filing of charges of violations as herein provided for.
It appearing to the City Council that it would be to the best interest for the said action to be taken immediately. This article shall be in full force and effect upon passage.
