It is the purpose of this chapter to establish minimum standards for the maintenance of lawns for vacant real property.
For the purpose of this chapter, the following words and phrases have the meaning respectively associated to them by this section.
ABANDONED
Lft without needed protection, care, or support; left by owner.
VACANT REAL PROPERTY
An improved parcel with a building or structure (primarily used for residency) that is abandoned.
Grass shall not be allowed to grow in excess of 10 inches. This provision shall not apply to land under cultivation, naturally wooded areas, or undeveloped areas that are at least 200 feet distant from any occupied building or residence.
The grass and vegetation fronting a public street shall be maintained so that all growth between the edge of the roadway and walkways or sidewalks shall be cut at least once a month commencing May to October, inclusive.
A. 
Yard waste.
(1) 
Brush and tree pruning.
(a) 
Brush and tree pruning will be collected by the Town Highway Department during the annual spring cleanup.
(b) 
Brush and tree pruning bundles to be collected during the annual spring cleanup shall not exceed four feet in length or three feet in diameter.
(c) 
Brush and tree pruning must be bundled with cut ends in same direction.
(2) 
Grass clippings and leaves:
(a) 
Grass clippings or leaves will be collected by the Town Highway Department during the annual spring clean-up.
A. 
In addition to all other authority conferred by law, the Code Enforcement Officer shall have the authority to serve thereal property owner with a notice of violation of the chapter. Notice shall be served either personally or by certified mail. The real property owner shall have 14 days to cure the violation.
B. 
If the violation is not cured within 14 days of service or from the mailing of the certified mailing, the Town shall cure the violation and shall levy the cost of same upon the real property in the same manner as; other taxes with the Town.
In addition to the provisions in § 302-6B, a violation of this chapter shall be punishable by a fine of not more than $250.
Should any section or provision of this chapter be decided by the courts to be unconstitutional or otherwise invalid, such decision shall not affect the validity of this chapter as a whole or any part thereof other than the section or provision so declared to be unconstitutional or invalid.
This chapter shall take effect immediately upon filing with the Secretary of State.
