Certain words and phrases are used in this article which, for the purpose hereof, are defined as follows:
ALUMINUM CANS
Empty all-aluminum beverage and food containers.
ASHES
The residue from the burning of wood, coal or other combustible materials.
BULK ITEMS
Any large, heavy, and/or bulky household appliances, furniture, furnishings, and carpet (unless cut into four-foot lengths each of which shall count as one item) which cannot be easily and safely placed in the collection vehicles used for collection and removal of solid waste within the Township of Mullica. This definition excludes construction debris and tires.
CARDBOARD or CORRUGATED PAPER
Clean, heavy box materials commonly known as "cardboard boxes" and similar heavy-paper packaging containers that are free of plastic, foam, and other contaminants, also including food-packaging boxes and other commercial packaging that is free of food contaminants, plastic, wax, and foam materials that would make it unsuitable for recycling purposes.
CHIPBOARD
Pressed paperboard (non-corrugated cardboard).
COMBUSTIBLE WASTE
Yard trimmings, rags, waste wood or cardboard and other combustible waste solids of a volatile or explosive nature.
COMMERCIAL ESTABLISHMENTS
Those properties used primarily for commercial purposes and those multiple dwelling residential buildings containing more than four dwelling units.
CONSTRUCTION DEBRIS
Any scrap lumber, metal, earth, sand, bricks, stone, plaster, roofing and siding material, and other debris of a similar nature which accumulates and is incidental to the construction or renovation of homes, buildings, public works or other projects.
CONSUMER ELECTRONICS (a.k.a. E-WASTE)
Fifteen-to-twenty-one-inch monitors, flat screens and all-in-ones; towers, desktops and laptops; uninterrupted power supply; keyboards, mouse and speakers; all type of wire; gold clip ends; printers, fax machines, scanners, modems, copy machines; all types of memory; any hard drives; fans and power supplies; mother, B, C, tweener and finger boards; AD adaptors, yokes and motors; plastic, baled or loose; aluminum, brass, light iron and copper; metals, baled or loose; any and all related computer parts; phones, cell phones, cell phone and laptop batteries; PC scrap and stereos (no wood); VCRs, DVDs, CD players, boom boxes; any audio and visual equipment; scanners and pagers; cash registers and scales (electronic or mechanical); rechargeable batteries; household appliances not containing compressors.
CONTRACTOR
A person or firm engaged in a business of service, construction, repairing, refurbishing, remodeling or the demolition of buildings or grounds within the Township.
FERROUS CONTAINERS
Empty steel or tin food or beverage containers.
GARBAGE
All refuse, entrails and waste of animals and fish, and all vegetable matter which has been or was intended to be used as food; all clam, oyster, crab and lobster shells; and all other items that are construed as garbage by the rules, regulations, or specifications of the New Jersey State Board of Health; and any animal or vegetable waste solids resulting from the handling, preparation, cooking or consumption of foods and nonrecyclable waste consistent with domestic habitation, but not including human wastes.
GLASS CONTAINERS
Bottles and jars made of clear, green, or brown glass. Expressly excluded are noncontainer glass, plate glass, blue glass and porcelain and ceramic products.
HAZARDOUS MATERIALS
All waste which is deemed to be chemical waste, hazardous waste, or infectious waste as defined by N.J.A.C. 7:26-1.4, and which shall include but not be limited to wastes which are flammable, corrosive, or explosive or which by themselves or in combination with other waste would be hazardous to life or property; and all other wastes presenting a clear danger to health and safety by reason of their pathological, explosive, radiological, or toxic characteristics.
INSTITUTIONAL ESTABLISHMENTS
Those facilities which house or serve groups of people, including but not limited to hospitals, schools, nursing homes, libraries, and government offices. Institutional establishments must arrange for private collection of waste materials and recyclables.
NEWSPAPER
Paper of the type commonly referred to as "newsprint and distributed at fixed intervals, having printed thereon news and opinions, and containing advertisements and other matters of public interest. Expressly excluded, however, are newspapers which have been soiled. Newspapers shall be deemed soiled if they have been exposed to substances or conditions rendering them unusable for recycling.
NONRECYCLABLES/SOLID WASTE/TRASH
The following items are nonrecyclables: polystyrene egg cartons, plastic food wrap, napkins, paper towels, paper plates, Styrofoam plates and cups, mirrors, window glass, light bulbs, drinking glass, ceramic glass, china dishware, plastic toys, plastic utensils, and plastic flower pots. All nonrecyclable items shall be disposed of as solid waste unless otherwise directed by the Township.
NONRESIDENTIAL USER
Any type of commercial, industrial, industrial, or business establishment, conducting a business whether for profit or nonprofit, and any apartment house, hotel, country club, or dwelling house having more than two dwelling units. Nonresidential users must arrange for private collection of waste materials and recyclables.
PERSON
Every owner, lessee and occupant of a residence, commercial, or institutional establishment within the boundaries of Mullica Township.
RECYCLABLE MATERIALS AND PRODUCTS
Those materials which would otherwise become municipal solid waste and which are accepted by the Atlantic County Utilities Authority as materials which may be separated, collected, or processed and returned to the economic mainstream in the form of raw materials or products. Recyclable materials include aluminum cans, newspaper, magazines, catalogs, cardboard or corrugated paper, chipboard, glass bottles, ferrous containers, vegetative waste, grass clippings, brush, small quantities of wood (lumber), metal, appliances, and certain consumer electronics generated as a result of domestic habitation of residential households.
REFUSE
All putrescible and nonputrescible solid wastes, including garbage, rubbish, ashes, street cleanings, dead animals and market, commercial and industrial wastes.
RESIDENCE
Any occupied single- or multifamily dwelling having not more than two dwelling units per structure.
RESIDENT
Any person occupying or maintaining a place of residence within the Township.
RESIDENTIAL USER
A dwelling unit such as a home or a multifamily dwelling of two or fewer residential units and any property defined as an apartment (4C) on the Township tax rolls.
RUBBISH AND TRASH
Nonrecyclable combustibles and noncombustible material generated as a result of domestic habitation of residential households.
SOLID WASTE
Municipal solid waste shall consist of "Type 10" solid waste as defined in N.J.A.C. 7:26-2.13(g)(1)(i) or any successor regulation governing the definition of municipal solid waste. This shall include dried latex paint cans and alkaline batteries which can be placed into the trash collection containers.
SOLID WASTE COLLECTION CONTRACTOR
A person or firm for hire, properly licensed in the State of New Jersey for the purpose of collection of solid waste and solid waste materials.
STREET, SIDEWALK, CURB, ALLEY
Any accepted public street, curb, sidewalk, or alley within the Township of Mullica.
TRADE WASTE
All material produced from any business, trade, or industry, whether or not conducted for profit, and shall include paper, rags, leather, rubber, cardboard and corrugated paper, wood, sawdust, garbage, combustible and noncombustible solids except manure, metals, metal shavings, wire, aluminum and ferrous containers, cinders, and other materials excluding wastes resulting from building construction or alteration work.
WASTE MATERIAL
Includes any and all garbage, refuse paper, ashes, and wastes from building construction or alteration work regardless of how originating; and shall also include cellar or yard dirt.
A. 
The Township and ACUA shall establish a weekly collection schedule which the Township and ACUA reserve the right to change upon notice.
B. 
Solid waste shall be collected weekly. Recycled materials, other than those required to be deposited at the Township Transfer Station, shall be collected biweekly.
C. 
All trash and recyclable material shall be placed in containers and inconspicuously stored on the property.
D. 
Roadside placement of trash and recyclable material is permitted beginning at 12:00 noon the day before a scheduled collection, and all empty containers shall be removed by 12:00 noon the day after collection.
E. 
Solid waste and recyclable containers shall be clearly marked as to content, and on collection days when solid waste and recyclables are being collected the containers shall be placed 10 feet apart.
A. 
Only the following recyclable items and materials shall be accepted for roadside collection on the days designated for collection of recyclables: paper, magazines, corrugated paper and cardboard boxes, chipboard, glass containers, aluminum cans, steel cans, ferrous containers, and plastic bottles labeled No. 1 and No. 2.
B. 
The Township and the ACUA reserve the right to from time to time amend the list of accepted recyclable items and materials upon notice which shall from time to time be posted on the ACUA website www.acua.com/mullica.
C. 
All other recyclable items and materials accepted by the Township shall be brought by the resident to the Mullica Township Transfer Station as set forth in Article II of this chapter.
A. 
Refuse containers shall be provided by the owner, tenant, lessee, or occupant of the property.
B. 
Refuse containers shall be maintained in clean, safe, and proper condition. Any container that does not conform to the provisions of this article or that may have ragged or sharp edges, or any other defect liable to hamper or injure the person collecting the contents of the container, shall be promptly replaced upon notice. In addition to a citation and imposition of a fine, or penalty, the Township shall have the authority to refuse collection services for failure to comply.
C. 
The refuse container shall be of galvanized metal or of plastic composition, shall have a tight-fitting lid or cover, shall have two sturdy handles or one single cross-bar handle for wheeled carts, shall not exceed 50 pounds for up to and including thirty-two-gallon containers or 336 pounds for ninety-six-gallon wheeled carts. Containers shall not be allowed to collect or retain rainwater. The collector may, at its discretion, refuse to collect refuse in any container in which the gross weight limits. Wooden, cardboard, composition paper, fiber, or similar containers are specifically prohibited for use as refuse containers. The collector may, at its discretion, refuse to collect refuse in such prohibited container or remove such container and dispose of it as refuse.
D. 
All garbage, before being placed in the container for collection, shall have been drained of all free liquids and securely wrapped in paper. All rubbish shall be drained of liquid before being deposited into the container for collection.
E. 
All solid waste, when placed outside for collection, shall be secured within the containers so the contents thereof do not leak or spill upon the streets and private property within the Township.
F. 
The Township of Mullica shall collect two bulk items per week, per household during the regularly scheduled trash pickup. Bulk items shall not exceed 50 pounds in weight. Appliances and white goods shall be disposed of in accordance with the Township of Mullica's recyclable program.
G. 
Any material that is above the volume limit or bulk item limit is the responsibility of the resident to properly dispose of. The material may not be placed or remain within the public right-of-way for multiple collection cycles.
H. 
No hazardous materials shall be placed or set out for collection either by itself or with other permitted materials which may be collected pursuant to this article. The resident is responsible to turn in hazardous materials in accordance with Atlantic County regulations.
I. 
Recycling is mandatory. All residents must separate recyclable materials as directed herein. Trash containing substantial recyclable materials will not be collected by the Township. Rejected receptacles will be tagged with a label indicating the reason for rejection.
J. 
All refuse, except trade wastes, accumulated in the Township shall be collected, conveyed, and disposed of by the Township or its duly authorized contractor for such purposes (collectively, the "contractor"). No other person shall collect, convey over any of the streets or alleys of the Township or dispose of any refuse accumulated in the Township, except in strict compliance with the provisions of this article and any other applicable law, rule, regulation, or ordinance.
K. 
This article shall not prohibit the actual producers of refuse, or the owners of premises upon which refuse has been accumulated, from personally collecting, conveying, and disposing of such refuse, provided that such producer or owners comply with the provisions of this article and with any other applicable law, rule, regulation, or ordinance.
In addition to any actions prohibited under § 225-2.3, the following actions are specifically prohibited:
A. 
No person shall place any refuse in any street, alley, sidewalk, or other public place within the Township, or upon private property, whether owned by such person or not, except in proper containers for collection. Nor shall any person throw or deposit any refuse in any stream or other body of water within the Township.
B. 
No person shall cast, place, sweep, or deposit anywhere within the Township any refuse in such a manner that it may be carried or deposited by the elements upon any street, sidewalk, alley, sewer, or other public place or into any occupied premises within the Township.
C. 
Any accumulation of refuse on any premises, except in the manner herein provided is hereby declared to be a nuisance and is strictly prohibited.
