As used in this article, the following terms shall have the meanings indicated:

Except as otherwise provided in § 199-36, no person shall drink or otherwise consume any alcoholic beverage, or offer an alcoholic beverage to another person for the purpose of consumption, in any commercial establishment where persons congregate for any purposes whatsoever, unless such establishment holds a valid retail consumption license issued by the Township or the New Jersey Division of Alcoholic Beverage Control.
Except as otherwise provided in § 199-36, no person owning or operating any commercial establishment, whether or not food or beverages are sold or served on the premises, shall serve or permit or allow the consumption of alcoholic beverages on the premises, unless such establishment holds a valid retail consumption license issued by the Township or the New Jersey Division of Alcoholic Beverage Control.

This article shall be enforced by any member of the Township of Union Police Department and any Township of Union Health Inspector who may issue a summons for a violation of any ordinance of the Board of Health.

Any person violating any of the provisions of this article shall, upon conviction thereof, be subject to one or more of the following: imprisonment in the county jail or in any other place provided by the municipality for the detention of prisoners for any term not exceeding 90 days or by a fine not exceeding $2,000 or by a period of community service not exceeding 90 days, to become effective on the effective date of this article.
