In order for the Town of Islesboro to encourage property owners
to repair and improve their private properties while ensuring that
unpaved town ways that provide access to those properties are not
damaged by construction equipment or traffic and in order for the
Town to maintain unpaved town ways in a manner that is safe and convenient
for motor vehicle traffic, the Town adopts this "Town of Islesboro
Unpaved Town Way Escrow Policy" (the "Policy").
Prior to issuance of a mud season permit, the permit applicant
shall arrange for a cash deposit of $5,000 (the "escrow deposit")
to be made into a non-interest-bearing account controlled by the Town
of Islesboro.
As a condition of issuance of any mud season permit, the permit
holder agrees to defend, indemnify, and hold harmless the Town of
Islesboro from any loss, liability, cost, and expense incurred by
the Town with respect to its receipt, deposit, management and/or return
of the escrow deposit.
Any and all restoration of an unpaved town way as required by
this policy shall be performed by the Town of Islesboro or its agents.
In no event shall the holder of a mud season permit, or his/her/its
agents, contractors, or other designees, perform such work.
