A.
When signs are erected lawfully, giving notice thereof, no person shall park a vehicle at any time upon any of the streets or parts of streets designated as prohibited parking areas by this chapter or by temporary regulations.
A.
No person shall park a vehicle or tractor or permit it to stand, whether attended or unattended, upon a street or highway or in any of the places delineated in §§ 3353 and 3354 of the Pennsylvania Motor Vehicle Code.
(1)
Within an intersection.
(2)
On a crosswalk.
(3)
Between a safety zone and the adjacent curb, or within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless local officials shall indicate a different length by signs or markings.
(4)
Within 25 feet from the intersection of curb lines, or, if none, then within 15 feet of the intersection of property lines at an intersection of highways.
(5)
Within 30 feet upon the approach to any official flashing signal, stop sign or traffic signal located at the side of the roadway.
(6)
Within 15 feet of the driveway entrance to any fire station.
(7)
Within 15 feet of a fire hydrant.
(8)
On a sidewalk.
(9)
In front of a private driveway, or alongside any street or highway excavation or obstruction, nor opposite the same, unless a clear and unobstructed width of not less than 20 feet upon the main traveled portion of the street or highway shall be left free for passage of other vehicles thereon.
(10)
On the roadway side of any vehicle stopped or parked at the curb or edge of the highway.
(11)
At any place where official signs have been erected prohibiting standing or parking.
(12)
Within 50 feet of the nearest rail or railway crossing.
(13)
Except when necessary in obedience to traffic regulations or traffic signs or signals or where angle parking is permitted, the operator of a vehicle shall not stop, stand or park such vehicle on the highway within a business or residence district other than parallel within the edge of the highway, headed in the direction of the traffic, and with the curb side of the vehicle within six inches of the edge of the highway or curb.
(14)
No person shall park a vehicle at any time in front of, opposite to, or in such a position as to block entrance to or exit by a vehicle from a garage.
A.
No person, other than the property owner or his/her designee, shall park a vehicle, at any time, in front of, or in such a position as to block the entrance to or to deny access or exit by a vehicle from a public or private driveway or garage. Any vehicle parked within five feet of any corner at the intersection of the driveway and the public thoroughfare of the public or private garage or driveway or in such a way that impedes the flow of traffic or creates an obstruction.
A.
No vehicle shall be stored upon any street or Borough-owned parking lot. As used herein, "stored" means the parking of a vehicle in one place upon any street or borough-owned parking lot continuously for over 72 hours.
A.
No person shall park or leave on the streets, highways or public property of the Borough any of the following:
A.
The owner or person in charge of any motor vehicle shall not permit it to stand unattended on any street, private driveway, public or private parking lot, used or new car sales lot or any other unattended open space which is readily accessible to any person without having locked the ignition of such motor vehicle and removed the ignition key from its lock.
B.
Any police officer or parking enforcement personnel of the Borough who finds a motor vehicle left in the condition set forth in Subsection A hereof may immediately lock such vehicle's ignition, remove the key from the lock and deliver it to the officer in charge of the Police Department. The police officer shall leave notice of any violation found in a conspicuous place on such vehicle, which notice shall also state where the ignition key has been taken and held.
C.
The registered owner of a vehicle found in violation of this article shall be prima facie responsible for such violation.
A.
Any resident of the Borough, after acquiring a person with disability or disabled veteran license plate or placard from the commonwealth, may make application to the Borough for an on-street disabled parking space. The applicant must meet the following criteria:
(1)
Applicant must reside at the address of the requested location.
(2)
Applicant has a physical impairment which significantly restricts their ability to walk distances.
(3)
The area of applicant's home is congested such that it is common and usual that parking on the public street immediately adjacent to the applicant's home is not available.
(4)
The applicant, or household member, frequently uses an automobile.
(5)
The applicant does not have access to off-street parking and/or there are no other alternatives which reasonably accommodate the applicant's disability.
(6)
The traffic and parking conditions tolerate safely and legally a parking space at the requested location.
B.
Applications can be obtained via the Wilson Borough Police Department or the Wilson Borough website, and when completed shall be returned to the Police Department. If the application is approved, a fee of $125 will be used to cover the costs of materials and labor involved in the installation of any approved signs. Such fee is nonrefundable.
C.
The Police Department shall review the application for completeness, inspect the area of the proposed disabled parking space, in order to determine what impact, the placing of a sign would have on the flow of traffic or safety in the area.
D.
Such application, along with a report and recommendation as aforesaid by the Borough Police Department, shall be forwarded to the Mayor.
E.
The Mayor shall review such application, and refer same to Wilson Borough Council who shall determine whether or not the applicant shall be granted a disabled parking space.
F.
No more than one application per household shall be accepted. No more than two disabled signs shall be placed within one Borough block, except when council has supporting facts from the Chief of Police and/or applicant which would justify an additional space. A disabled parking space shall be limited to a maximum of 20 feet in length, and will be placed within the property lines of the residence, but otherwise shall be subject to the discretion of the Wilson Borough Police Department.
G.
A sign shall be installed specifically identifying the disabled on-street parking space as being special permit resident-disabled parking only, and a special permit shall be issued to the resident, which shall be placed in the window of the resident's vehicle or be available for production, if requested by law enforcement, which indicates that the applicant is a disabled resident in possession of the aforesaid special, permit. All resident-disabled parking spaces are available to anyone holding a Wilson Borough resident-disabled parking permit.
H.
The Police Department shall review the existing disabled parking spaces on an annual basis to determine the continued need. If there is a determination that a space in no longer necessary, the Police Department shall make the final determination as to whether the existing permit for the disabled parking space shall be removed.
I.
Any person violating this section shall be subject to penalties and fines as specified in § 162-51, Fees.
J.
All related fees must be paid within 30 days of being approved by Council.
K.
Residents who were granted a disabled or handicap parking space prior to the enactment of this chapter will be assessed a fee of $45 to cover the costs of a new sign and permit.
A.
No person shall park, stand or leave in any zone designated as a tow-away zone any vehicle or trailer, whether attended or unattended. Any motor vehicle as defined by the Pennsylvania Motor Vehicle Code shall be towed without further notice to the owner.
A.
No person shall park, stand or leave in any zone designated as a fire lane or zone any vehicle or trailer, whether attended or unattended. All fire lanes or zones are designated as immediate tow-away zones, with no further notice required.
B.
The area within 15 feet of a fire hydrant will be considered a fire lane or zone.
A.
No person shall cause, allow, permit or suffer any vehicle registered in the name of or operated by such person to be parked where signs are erected lawfully giving notice thereof for the purpose of cleaning the Borough street during the time and day posted on the sign.
A.
No person shall park or leave unattended a vehicle on private property without the consent of the owner or other person in control or possession of the property except in the case of emergency or disablement of the vehicle, in which case the operator shall arrange for the removal of the vehicle as soon as possible.
B.
The provisions of Subsection A shall not apply to private parking lots unless such lots are posted to notify the public of any parking restrictions and the operator of the vehicle violates such posted restrictions. For the purposes of this section, "private parking lot" means a lot open to the pubic or used for parking without charge or a parking lot used for parking with charge. Posting shall be in accordance with Pennsylvania Title 67, Transportation, and Pennsylvania Title 75, Vehicle Code.
C.
Property owner may remove the vehicle. The owner or other person in charge of possession of any property on which a vehicle is parked or left unattended in violation of the provisions of Subsection A may remove or have removed the vehicle at the reasonable expense of the owner of the vehicle. Such person who removes a vehicle left parked in violation of Subsection A shall have a lien against the owner of the vehicle in the amount of the reasonable costs of removing the vehicle.
A.
No person shall abandon a vehicle on public or private property without the express or implied consent of the owner or the person in lawful possession or control of the property.
B.
Property owner may remove the vehicle. The owner or other person in charge of possession of any property on which a vehicle is parked or left unattended in violation of the provisions of Subsection A may remove or have removed the vehicle at the reasonable expense of the owner of the vehicle. Such person who removes a vehicle left parked in violation of Subsection A shall have a lien against the owner of the vehicle in the amount of the reasonable costs of removing the vehicle.
C.
For the purposes of this section, a vehicle (other than a pedal cycle) shall be presumed to be abandoned under any of the following circumstances, but the presumption is rebuttable by a preponderance of the evidence:
(1)
The vehicle is physically inoperable and is left unattended on public or private property for more than 48 hours.
(2)
The vehicle has remained illegally on public or private property for more than 48 hours without the consent of the owner of the property.
(3)
The vehicle is on public or private property and does not bear a valid registration plate, a valid certificate of inspection, and an ascertainable vehicle identification number.
D.
Before the owner of any property removes an abandoned vehicle from his property, he shall obtain a copy of Pennsylvania Department of Transportation form MV-952, Police Request for Removal of Abandoned Vehicle.
A. OPERATOR PARKING METER PARKING METER ZONE PERSON STREET VEHICLE
Unless otherwise clearly indicated, the following works, whether singular or plural, appearing in this chapter shall have the respective meanings ascribed to them in this section.
Every person who shall operate a vehicle as its owner, or agent, employee or person lawfully operating the same by the consent of the owner, or in the control thereof.
Such instrument or device designated and intended to assist the public authorities of the Borough in enforcing ordinances, limiting the time during which vehicles may be parking on any street within any such parking meter zone.
Any street, highway, public place or portions thereof upon which parking meters are installed, operated and used.
Includes every natural person, firm, partnership, association or corporation.
Any public street, road or highway or other public place located in the Borough of Wilson and established for the use of vehicles.
Any device in, upon or by which any person or property is or may be transported upon a street or highway, excepting a device which is operated upon rails or tracts.
Parking meter zones are hereby established on the following streets or portions thereof, as follows:
A.
Zone No. 1: Lehigh Street, from S. 20th Street to S. 21 St. Street, both sides. Lehigh Street from S 21st Street to S 22nd Street, south side. Lehigh Street, 2200 block, both sides.
B.
Zone No. 2: Fairview Avenue, from 20th Street to 22nd Street, both sides.
C.
Zone No. 3: S. 20th Street, from Washington Boulevard to Ferry Street, both sides.
D.
Zone No. 4: S. 21st Street, between Washington Boulevard and Lehigh Street, west side. S. 21st Street from Fairview Avenue to Ferry Street, east side.
E.
Zone No. 5: S. 22nd Street from Fairview to Washington Boulevard, west side.
Parking in any of the aforesaid parking meter zones is hereby limited to a period of time not exceeding three hours at any time between the hours of 9:00 a.m. and 9:00 p.m. Monday through Sunday.
In all parking meter zones, a parking meter bearing instruction shall be installed for every parking space. All such spaces shall be plainly designated by marked lines upon the street and may be placed either parallel, diagonal, or perpendicular to the curb.
Every vehicle parked in any parking meter zone shall be entirely within the line of designated parking space with the front end of such parked vehicles at or immediately adjacent to the parking meter controlling such parking space.
A.
The owner or operator of a vehicle shall, immediately upon entering any parking space controlled by such parking meter, deposit one or more proper coins of the United States of America. Upon the deposit of coin, coins, and placing the meter in operation, by following operating instructions on the meter, the parking space may be lawfully occupied by the vehicle for the time indicated on the meter. If any vehicle shall remain in any such parking space for such length of time that the meter shall indicate by proper signal that the lawful parking time has expired, that vehicle shall be considered as having been parked overtime, and the parking of a vehicle overtime shall be a violation of this article.
The coins required to be deposited in parking meter as aforesaid, are hereby levied and assessed as fees to provide for the proper regulations and control of traffic upon the streets in Wilson Borough, including the cost of supervision and regulating the parking of vehicles in the aforesaid zones created hereby and the cost of purchase, supervision, protection, inspection, installation operation, maintenance, control and use of the aforesaid parking meters. The coins so deposited in said parking meters shall be collected and accounted for under the direction of the Chief of Police and shall by him or his designee be deposited at least once every three weeks in the financial institution designated by the Borough Manager.
No person shall deposit or cause to be deposited in any parking meter any slug, device or metallic substitute for the required legal coins of the United States.
No person shall open, deface, injure, tamper with or willfully break, destroy or impair the usefulness of any parking meter installed by authority of the Council of the Borough.
Nothing in this chapter shall be construed as prohibiting the Borough Council, from providing free parking space for loading or unloading of commercial vehicles, for bus stops, for taxicab stands, or for any other matters of a similar nature, nor from establishing additional parking zones.
The duty of enforcing the provisions of this chapter shall be upon the Mayor of the Borough acting through the Department of Police. In case of emergency, any of the provisions of this hereof may be temporarily suspended by the Mayor, who acting directly or through the Chief of Police, shall have the authority to adopt and enforce such other temporary rules and regulations as traffic conditions during such emergency may require.
It shall be the duty of the police officers of the Borough or meter personnel, acting under instructions issued by the Chief of Police, to deposit appropriate stub or violation tickets in a properly designated receptacle to be maintained in the police department. Such stub or violation ticket shall disclose the following information:
A.
The number of each parking meter which indicates that the vehicle occupying the parking space adjacent to or controlled by such meter is or has been parked in violation of any of the provisions of this chapter.
B.
The state license number of such vehicle.
C.
The day and hour at which time such vehicle is or was parked in violation of any of the provisions of this chapter at the time of inspection.
D.
Any other essential facts describing the circumstances pertaining to such violation.
E.
Every police officer or member of the meter department, discovering any such violation, shall also place on such vehicle a written or printed notice to the owner or operator thereof that such vehicle has been parked in violation of the provisions of this chapter and directing such owner or operator the procedure in which to make payment. The owner or operator shall submit payment within the time designated, and submit such violation ticket to the Wilson Borough Police Department. The failure of such owner or operator to make such payment shall render said owner or operator subject to the penalties hereinafter. The Chief of Police or his designee, receiving payment of such penalty shall issue a written receipt for payment, keep a duplicate thereof and shall forthwith transmit all monies so received to the Borough Manager.
Any person violating any provision of this article is subject to a penalty of a fine specified in § 162-51, Fees.
