This Chapter and other ordinances of the City, where applicable, shall apply and be in force in the City Park as designated by the Board of Aldermen for the City of Duquesne, Missouri. The City of Duquesne Police Department is authorized and empowered to enforce the provisions of this Chapter and other ordinances of the City, as well as all of the rules and regulations governing use of the City Park when approved by the Board of Aldermen. The Board of Aldermen may approve rules and regulations governing the use of the City Park, including the allowance of prohibited activities under Section 240.040, under such conditions as the Board may prescribe.

The City Park described in this Chapter and located adjacent to and south and east of 1501 South Duquesne Road shall be known as, and is hereby named, Duquesne Memorial Park.

Any person who shall violate any of the provisions of this Chapter, or who shall violate any of the rules and regulations of the City adopted as provided in Section 240.010, shall be guilty of an ordinance violation.

The City Park shall be open from dawn to dusk, and the City Park shall be closed at all other times. During the period that the park is closed, presence in the park shall be prohibited unless the closing period is extended, in writing, by the Board of Aldermen.

A. 
It shall be unlawful for any person to engage in the following activities:
1. 
Tents/structures.
2. 
Smoking/vaping/illegal drugs/alcoholic beverages.*
3. 
Loud music.
4. 
Firearms/weapons.*
5. 
Hunting.
6. 
Open fires.
7. 
Motorized or flying vehicles (mobility carts allowed).
8. 
Solicitation or sales of any product.*
9. 
Organized team sports.
10. 
Dangerous projectiles.
11. 
Unleashed pets/animal waste not properly disposed.
* Note: These activities are currently regulated by Sections of the Municipal Code of the City of Duquesne, Missouri, and those Sections are controlling.

As used in this Chapter, the following terms shall have the meaning set out herein:
DANGEROUS PROJECTILES
Any object thrown or struck so as to pose a risk of injury to bystanders or property.
FLYING VEHICLES
Includes, but is not limited to, unmanned aerial vehicles (UAVs), drones, and remote-controlled aircraft.
OPEN FIRES
Any fire within the City Park at any place other than a place designated for such purpose by the Board of Aldermen.
ORGANIZED TEAM SPORTS
Any game that is directed by adult or youth leaders and involves three (3) or more persons who play and/or practice together regularly as a team in a league or association.
TENTS/ STRUCTURES
Includes, but is not limited to, any tent, building, booth, stand, or other structure in the City Park without the prior written approval of the Board of Aldermen.
