As used in this chapter, the following terms shall have the meanings indicated:
ABANDONED OR JUNKED MOTOR VEHICLE
Any motor vehicle not bearing both a current valid motor vehicle registration plate and a current vehicle inspection sticker, or not capable of being operated without mechanical repair, adjustment or replacement of a part or parts. Vehicles "abandoned or junked" as defined above will be in violation if stated conditions described exist for a period of 48 hours or more. Vehicles must be operable, on demand, by a Borough Police Officer or Borough Official.
On or after the date of passage of this chapter, it shall be unlawful at any place within the Borough of New Cumberland to keep or store or to permit to be kept or stored any abandoned or junked motor vehicle except within the confines of a completely enclosed building or garage.
A. 
Any person violating any of the provisions of this chapter shall, upon conviction therefor, be sentenced to pay a fine of not less than $10 nor more than $100 and costs of prosecution and, in default thereof, to suffer imprisonment for not more than 30 days. A separate offense shall be deemed committed on each period of 10 days during which a violation of this chapter continues.
B. 
In addition to the foregoing penalty, the Borough may require the owner or occupier of the property to remove any accumulation of refuse or abandoned or junked motor vehicle and, should said person fail to remove the same within 10 days of written notice, the Borough may cause the same to be done and collect the costs thereof together with a penalty of 10% of such costs in the manner provided by law for the collection of municipal claims or by action in assumpsit or may seek relief by bill in equity.
