A. 
Every person seeking to make connection to the sewer collection system shall make such connection at their own expense after securing a permit as outlined in § 176-3.05 and paying the applicable impact fee. Every user of the sewer system who increases use of the system shall pay the impact fee required in accordance with provisions of this chapter and the fee schedule adopted by City Council.
A. 
Applicability. The WRRD impact fee established by this article shall apply to all new construction or any change of use which results in new or increased discharge of wastewater to the water resource recovery facilities.
B. 
The WRRD impact fee is established based on the number of flow units which any particular use can be anticipated to produce. A single flow unit (also termed "equivalent dwelling unit") is based on an anticipated load of 185 gallons per day. Appendix A and B, attached hereto and a part hereof,[1] set forth a schedule of the flow units for those uses listed. The rate shall be established by the City Council after a public hearing.

At such times as deemed necessary, the Director may recommend to City Council whatever changes they think appropriate to the WRRD impact fee schedules. The City Council may make amendments to the WRRD impact fee schedules, by order.
(2) 
No building permit or certificate of occupancy, whether for new use or construction or structural change or change of use, may be issued until the impact fee under this chapter has been paid.

C. 
All revenue generated by this article shall be placed in a nonlapsing fund, to be used only for improvements to the existing water resource recovery facilities, sewers, City pump stations, construction of additional treatment facilities, and debt repayment for construction, repair and maintenance of the WRRF.
D. 
The WRRD impact fee shall be calculated as follows:
WRRD impact fee = wastewater discharge gal/day X rate/gallon established by the City Council after public hearing.

The rate shall be adjusted annually based on the cost of construction index established by the Engineering New Record (ENR). The index adjustment shall be based on the index established for July of each year.
E. 
Payment of impact fee. The WRRD impact fee shall be paid at the time the building permit is obtained. Nonresidential applicants may request to pay the fee in installments, through a written request to the Director.
F. 
For any change of use, or any structural expansion or alteration, or any change which results in an increase of flow or pollutant loading above the sewer use base level as determined by the Director, the user shall pay a charge per additional flow unit per Appendix A or B of this chapter[2] and the City Council's fee schedule.

All building units or building expansions requiring installation of a subsurface disposal system or expansion to an existing subsurface disposal system shall be subject to the subsurface disposal impact fee.
B. 
The subsurface disposal impact fee is based on the number of EDUs any particular use can be anticipated to produce and which will impact the WRRF. The rate shall be established by City Council after a public hearing.
C. 
At such times as deemed necessary, the Director may suggest whatever changes they think appropriate to the Subsurface Wastewater Disposal Impact Fee. The City Council may make amendments to this fee, by order. Any person seeking to install or expand a subsurface disposal system shall complete an appropriate form provided by the Code Enforcement Department. No building permit or occupancy permit, whether for new use or construction or structural change or change of use, may be issued until the fee under this section has been paid.
D. 
All charges generated by this section shall be placed in a nonlapsing fund and used only for improvements to the existing water resource recovery facilities or construction of additional treatment facilities.
E. 
All impact fees collected pursuant to this article shall be used to develop, design, construct, expand, improve, and/or install municipal wastewater treatment facilities and associated capital improvements, including but not limited to debt repayment and retiremet, for the handling, disposal and treatment of septic waste.
The City Council may review the impact fee rates and user charges and revise the rates and charges as necessary to ensure that adequate revenues are generated to pay the costs of operation and maintenance, including replacement and debt retirement, and that the system continues to provide for the proportional distribution of such costs among users and user classes.
