Borough of Avondale, PA Chapter 306 Parks and Recreation Areas

§ 306-1 Incorporation of resolution.

A. In accordance with Section 2701 of the Borough Code[1] (the Act of February 1, 1966, P.L. 1965, No. 581, 8 Pa.C.S.A. § 101 et seq., as amended to date), the Avondale Borough Council adopted Nonlegislative Resolution No. 01-06-01 on June 19, 2001; Resolution No. 01-06-01 in its entirety is hereby incorporated by reference into this chapter as if the same had been fully set forth herein.

B. The authority given to the Avondale Borough Council by Paragraph No. 4 of Resolution No. 01-06-01 to change, vary, alter, or modify the boundaries of the lands comprising the Avondale Borough Park System, or to eliminate or add to the Avondale Borough Park System, or to change the official names of the parks comprising the Avondale Borough Park System by a resolution duly adopted by the Avondale Borough Council, is hereby expressly retained.

§ 306-2 Authorization to enact rules and regulations.

A. By resolution, the Avondale Borough Council may adopt and implement such rules and regulations which it, in its sole discretion, deems necessary to govern the use of the Avondale Borough Park System itself, and all Borough parks comprising the Avondale Borough Park System.

B. Any rules and regulations adopted by the resolution pursuant to § 306-2A above, shall:

(1) Be kept on file at all times in the offices of Avondale Borough; and

(2) Be posted at conspicuous places in the parks comprising the Avondale Borough Park System.

§ 306-3 Violations and penalties.

A. Any person who violates any rule or regulation adopted by resolution by the Avondale Borough Council applicable to the Avondale Borough Park System shall, upon conviction in a summary proceeding under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. Upon judgment against any person by summary conviction, or by proceedings by summons on default of the payment of the fine or penalty imposed and the costs, the defendant may be sentenced and committed to the county correctional facility for a period not exceeding 30 days. Each day that such violation exists shall constitute a separate offense, and each rule or regulation that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this chapter in equity in the Court of Common Pleas of Chester County.

B. Every violation of any park rule or regulation shall be a separate offense.

C. In addition to the penalties provided by § 306-3A and B above, any person who has violated any rule or regulation of the Avondale Borough Park System shall, after conviction of the same, be prohibited from being present in or using any park comprising the Avondale Borough Park System for a period of one year, beginning with the date of conviction.
