As used in this article, the following terms shall have the meanings indicated:
EMERGENCY VEHICLE
Any Fire Department vehicle, police vehicle, ambulance, blood-delivery vehicle, emergency vehicle, armed forces emergency vehicle, any vehicle answering emergency calls, or any other vehicle designated by the Commonwealth of Pennsylvania State Police pursuant to 75 Pa.C.S.A. § 6106, its supplements or amendments.
GROSS WEIGHT
The combined weight of a vehicle or combination of vehicles and its or their load, including the weight of any and all occupants therein.
SCHOOL BUS
Any vehicle used solely for the transportation of school children and designed for carrying 10 or more passengers, exclusive of the driver.
STATE STREET BRIDGE
The currently existing bridge located on State Street within the municipal limits of Avondale Borough, Chester County, Pennsylvania, crossing the stream or waterway known as "Indian Run."
A. 
Except as hereinafter provided, no vehicle of any nature or combination of vehicles of any nature whatsoever having a gross weight in excess of 10 tons (20,000 lbs.) shall travel on, upon, or over the State Street Bridge.
B. 
The provisions of this article shall not apply to emergency vehicles or school buses, as defined in this article.
The Avondale Borough Council, upon written application to both the Borough Council and the Borough Engineer may, but need not, issue permits for the passage of vehicles whose gross weight is in excess of that set forth in § 405-23 in the definition of gross weight for the passage of such vehicles over the State Street Bridge. Avondale Borough, as a condition for the issuance of such permits, may require such undertakings or such security as it deems necessary to cover the cost of repairs and restoration necessitated by the permitted movement of the vehicles referenced in this subsection.
A. 
Avondale Borough shall maintain or erect (or cause to be maintained or erected) restriction signs identifying the weight restriction specified in § 405-24A above. These weight restrictions shall be erected at each end of the State Street Bridge, and shall face oncoming traffic.
B. 
The Borough shall erect and install (or cause to be erected and installed) and shall maintain such advanced informational signs at the intersections of those streets nearest each end of the State Street Bridge, which said advanced informational signs shall allow operators of vehicles whose gross weights are in excess of 10 tons (20,000 lbs.) to avoid passage over the State Street Bridge.
C. 
All signs to be erected and maintained pursuant to this subsection shall be of such size and configuration as comport with currently existing Pennsylvania Department of Transportation regulations.
Any person operating a vehicle or combination of vehicles on the State Street Bridge in violation of the provisions of this article shall be guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of $150, plus $150 for each 500 pounds, or part thereof, in excess of 20,000 pounds over the maximum allowable weight stated in § 405-24.
Any amendments made to the Act of June 18, 1980, P.L. 229, No. 68, Section 5 [75 Pa.C.S.A. § 4902(a) through (g), inclusive] shall automatically be incorporated by reference into this article without further action necessary by the Avondale Borough Council, unless the afore-referenced public law or portion of the Vehicle Code is repealed, in which case this article shall not be repealed, but shall operate as an duly adopted by the Avondale Borough Council pursuant to the authority contained in the Borough Code (the Act of February 1, 1966, P.L. 1656, No. 581, as amended).[1]
