The water rents established in the Village of Avon, Livingston County, New York, shall be based on a scale of rents called "water rents," the revenues from which shall be used for the payment of the cost of management, maintenance, operation and repair of the water system and pumping station, and in the event of any surplus thereafter, may also be used for the enlargement of the same and for the payment of the interest on any debt incurred for the construction of such water system for retiring such debt, and for such other purposes as deemed appropriate by the Board of Trustees.
A. 
Residential premises. Any private residence, apartment house or multiple-family dwelling located within the Village boundaries shall pay quarterly water rent based on the volume of water consumed by the quarter, multiplied by the Village water rate schedule for residential premises located in the Village.
B. 
Commercial, industrial and other premises. Commercial, industrial, all other premises and premises serviced by one water meter which have either a commercial or industrial use and a residential use, which are located in the Village, shall pay quarterly water rentals based on the volume of water consumed in the quarter, multiplied by the Village water rate schedule for commercial, industrial and other premises unless a different rate is established for a particular property or users by the Village Board of Trustees.
C. 
Water district rate.
(1) 
Premises located in water districts. The owners of premises located in water districts outside the Village boundaries shall pay quarterly water rentals based on the volume of water consumed in the quarter multiplied by the water rate schedule for water districts.
(2) 
Premises located outside the Village not within established water district. Premises located outside the Village boundaries and not in an established water district shall pay quarterly water rentals based on the volume of water consumed multiplied by the water rate schedule of premises located outside the Village and not within established water districts.
D. 
Rate schedules available for public inspection. The rate schedules used to determine water rental for the four different classifications and properties or users with special rates shall be kept on file with the Village Clerk in the Village offices and shall be available for public inspection.
A. 
Quarterly installments. All water rents shall be payable in quarterly installments payable February 1, May 1, August 1 and November 1. Water rents shall be billed on the same quarterly statements as sewer rents.
B. 
Penalty for late payments. If quarterly water rents are not paid by February 28, May 31, August 31 and November 30, a penalty of 10% shall be added.
C. 
Lien. Such sewer rents shall constitute a lien upon the real property served by water and such a lien shall be prior and superior to every other lien or claim, except the lien of an existing tax, water rent or local assessment.
A. 
All revenues imposed hereunder, together with all interest and penalties thereon, shall be kept in a separate fund to be known as the "water fund."
B. 
No expenditures chargeable against said water fund shall be incurred except upon authority of the Board of Trustees for a purpose for which such water fund has been established, as hereinbefore provided.[1]
