This article shall be known and cited as the "Moore Township Dog Law."

This article shall be enforced by the Moore Township Police Department unless otherwise designated by the Moore Township Board of Supervisors. The duties of the Animal Control Officer are attached hereto and made a part hereof as Exhibit "A."[1]

Any person violating any of the provisions of the Act or this article shall, upon conviction thereof before any Magisterial District Judge of the County of Northampton, be sentenced to pay a fine of not less than $100 nor more than $300, and the costs of prosecution, for each and every offense and, in default of payment of such fines and costs, shall undergo imprisonment in the Northampton County Prison for a period for not more than 90 days. Said fines and costs shall be in addition to any other charges or penalties imposed under the Act by this article.
If any provision or application of the Act or this article shall be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the other provisions or other applications of the Act or this article.
All ordinances or parts of ordinances inconsistent herewith are hereby and the same repealed.

Definitions. As used in this article, the following terms shall have the meanings indicated:
Includes all horses, cattle, jacks, burros, sheep, goats, mules, bulls, steer, cows, swine, calves, poultry, ostriches, emus and ratites.
No owner, custodian or keeper of livestock shall permit such livestock to run at large at any time either upon any of the streets or public grounds in the Township, or upon the property of any person other than the owner, custodian or keeper of such livestock, unless such livestock is accompanied by and under the immediate control of such owner, custodian or keeper.
Every owner, custodian or keeper of premises upon which livestock is housed, stabled, penned or otherwise kept shall erect and maintain around the area in which such livestock is permitted to graze unattended a fence with appropriate locks and closing devices of sufficient height and strength to restrain the livestock from leaving such area.

This article shall be enforced by the Moore Township Police Department. This article regulates building, housing, property, maintenance, health, public safety, and shall be enforced pursuant to 53 P.S. § 66601(c. 1)(2).

Enforcement thereof may be by an action before a Magisterial District Judge in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure. The Township Solicitor may assume charge of the prosecution without the consent of the District Attorney as required under Pa. R. Crim. P. No. 83(c) (relating to trial and summary cases). The Board of Supervisors hereby set a criminal fine not to exceed $1,000 per violation, and the costs of prosecution, and, in default of payment of such fine and costs of prosecution, to undergo imprisonment of not more than 90 days; provided, further, that each day's continuance of a violation shall constitute a separate event.

In the event any provision of this article is declared unconstitutional, unlawful, or unenforceable by a court of competent jurisdiction, such declaration shall not affect the validity of the remainder of this article or of this article as a whole, but shall continue in full force and effect as though the unconstitutional, unlawful, or unenforceable provision had never been a part hereof,
All ordinances or parts of ordinances conflicting or inconsistent with the provisions of this article hereby adopted are hereby repealed.
This article shall become effective five days after enactment.
