The penalty and fine provisions of all ordinances of the Township which regulate building, housing, property maintenance, health, fire, public safety, parking, solicitation, curfew, and water and/or noise pollution are hereby amended and shall be enforced as summary offenses under the Pennsylvania Rules of Criminal Procedure, pursuant to the mandate of Act 172 of 1996 (53 P.S. § 66601). Any person who shall violate any ordinance listed and described above shall be subject, upon being found guilty thereof before a Magisterial District Judge in a summary criminal proceeding commenced by this Township, to pay a fine not to exceed $1,000 per violation and to undergo imprisonment for a term not to exceed 90 days for each violation.

Penalties for violation of any Township ordinance not regulated under § 1-6 above or other applicable statute shall be enforced as a civil proceeding and violators shall be subject, upon being found guilty thereof before a Magisterial District Judge, to pay a fine not to exceed $600 per violation, plus court costs and reasonable attorney fees incurred by the Township in the enforcement proceedings.
Penalties for certain ordinances are set separately by applicable statute and shall be as set forth in those ordinances.
A separate offense shall arise for each day or portion thereof in which a violation is found to exist or for each section of the ordinance which is found to have been violated.
The provisions of this article shall be severable and if any of the provisions hereof shall be held to be invalid or unenforceable, the remaining provisions of this article shall remain in effect.
All ordinances and parts of ordinances inconsistent herewith be and the same are herewith repealed.
