No person shall keep, maintain or operate in any public place in the Borough to which the public is expressly invited any automatic vending machine or coin-operated phonograph or reproducing machine or automatic coin-operated machine of any type unless a license has been obtained. Licenses shall run from July 1 to June 30 each year.

A. 
In addition to general requirements, the application for a license shall also require:
(1) 
That the applicant is over 21 years of age.
(2) 
That the use does not conflict with the regulations of Chapter 28, Zoning.
(3) 
The serial number or other identifying characteristics of each machine, a description of the machine and the name of the manufacturer thereof.
(4) 
A statement that the machine will not be used for gambling.

A separate application shall be completed for each machine.

A. 
A license issued under this article may be transferred from the licensee to another person; but in such case, application shall be made by the prospective licensee in the same manner as the original application was made, provided that the fee in such case shall be $1.

Any licensee may transfer the license from one machine to another upon filing with the Borough Clerk a written statement that such transfer has been made.

In addition to the causes specified in § 4-1-10, the Borough Council may revoke any license issued pursuant to this article for the conduct of gambling in connection with the operation of any such machine or the creation of any condition resulting from the operation thereof which may, in the opinion of the Borough Council, constitute a nuisance, disturbance of the peace or undue annoyance to adjoining property owners or any condition that the Borough Council may deem detrimental to the welfare of the Borough. Where any person has his license revoked, he shall forthwith remove the machine or cause it to be removed out of the territorial limits of the Borough. If any person fails to remove a machine, the machine may be confiscated by the Police Department under the direction of the Borough Council, and for that purpose any member of the Police Department or any special officer may enter or break into the premises where the machine is located for the purpose of seizing the machine. Upon seizure, the machine may be sold under the direction of the Borough Council.

This article shall not apply to cigarette vending machines and cigarette machine operators nor to sanitary napkin machines in public schools not operated for profit.
