The National Electrical Code, including annex H, copyrighted by the National Fire Protection Association, save and except the deletions and additions set forth in exhibit A to Ordinance 2024-01-02, attached hereto and incorporated herein for all purposes, regulating the construction, alteration, removal, use and maintenance of any electrical wiring, apparatus, device and/or system within the city (2023 National Electrical Code). The 2023 National Electrical Code, including annex H, is made a part of this division as if fully set forth herein. Three (3) copies of the 2023 National Electrical Code are on file in the office of the city secretary being marked and designated as the 2023 National Electrical Code. The deletions and additions set forth in exhibit A to Ordinance 2024-01-02 are located on city's website under development services.

Any person, firm, corporation or business entity violating this division shall be deemed guilty of a misdemeanor, and upon conviction therefor, shall be fined a sum not exceeding two thousand and no/dollars ($2,000.00), and each and every day that such violation continues shall be considered a separate offense; provided, however, that such penal provision shall not preclude a suit to enjoin such violation. The city retains all legal rights and remedies available to it pursuant to local, state and federal law.

The following procedure shall be followed in adopting amendments to the applicable National Electrical Code:
(1) 
The city staff shall propose in writing to the city council amendments to the National Electrical Code and shall state the basis for such amendments.
(2) 
The city council shall review the amendments proposed by the city staff and the reasons therefor and may approve the same if it is deemed in the best interest of the city.
