MOBILE COLLECTION BIN (MCB)
A mobile container designed to collect used material (such as clothing, shoes and books, etc.) that will periodically be emptied and the contents that are removed will primarily be reused or recycled.
The property owner upon which a mobile collection bin is located must hold a license from the Sterling Board of Health for each MCB.
A. 
The maximum dimensions for each individual collection bin are:
(1) 
Width: six feet.
(2) 
Depth: four feet.
(3) 
Height: six feet.
B. 
A maximum of three mobile collection bins may be located on a single property. In the case of multiple MCBs, the bins must be located directly adjacent to one another.
Each MCB must be attractively painted and clearly identify the specific material(s) being collected. The owner of the MCB and the appropriate contact information must be identified on the outside of the bin in letters that are at least three inches in height.
A. 
A mobile collection bin may only be placed on a parcel of land that is currently being used for either commercial or industrial purposes that are unrelated to items being collected. Mobile collection bins are prohibited from being located on any parcel that has a residential component of use.
B. 
The specific location for each mobile collection bin must be approved by the Board of Health which will consider issues such as safety and ease of access from the public way, as well as traffic and pedestrian flow within the property. No MCB may be located within 10 feet of the nearest property line.
Material must be directly deposited into the bins. The owner of the property is directly responsible for maintaining the area around the bin(s) clean and completely devoid of any deposited material. Failure to maintain the area around the bin(s) will be cause for the Board of Health to revoke the MCB license(s) and order them to be removed from the property.
The Board of Health may vary any provision of these regulations with respect to any particular case when in its opinion: 1) the enforcement thereof would do manifest injustice, and 2) the applicant has demonstrated that the same degree of protection can be achieved without strict application of that particular provision. All variance requests shall be submitted to the Sterling Board of Health in writing and shall be considered and approved or disapproved by said Board of Health.
If any section or sentence, clause, or phrase thereof shall be held invalid for any reason, the remainder of that section and all other sections shall continue in force.
