(a) 
No person, firm or corporation shall operate or cause to be operated any truck or other commercial motor vehicle with a gross weight as prohibited by chapter 621 or 622 of the Texas Transportation Code, or as otherwise prohibited by division 2 of this article, whichever is more restrictive, over or upon any public roadway within the corporate limits of, or under the jurisdiction of, the town.
(b) 
Any person wishing to make a local delivery within the area may procure a permit to do so upon making a showing of necessity to the director of public works, who upon such showing will issue a permit for such local delivery. Such local delivery shall be unlawful without such permit.
(c) 
The town may procure and erect signs to give notice of the terms of this division.
(d) 
Any person violating the terms of this division shall be subject to penalty as provided for in section 1.01.009.

For the purposes of this division, the following words and phrases shall have the meanings respectively ascribed to them by this section:
Authorized emergency vehicle.
Any vehicles of the fire department or police department, public and private ambulances for which permits have been issued by the state board of health, emergency vehicles of municipal departments or public service corporations as are designated or authorized by the governing body of an incorporated city, private vehicles operated by volunteer fireman or certified emergency medical services employees or volunteers while answering a fire alarm or responding to a medical emergency, and vehicles operated by blood banks or tissue banks, accredited or approved under the laws of this state or the United States, while making emergency deliveries of blood, drugs, medicines or organs.
Business destination.
Any location within the town limits to which a commercial motor vehicle may travel for purposes of conducting the routine business activities normally associated with said vehicle. Business destinations shall include truck terminals, motor fuel stations, garages, places of repair, places of performing a service, and places of loading or unloading.
Commercial motor vehicle.
Any motor vehicle designed or used for the transportation of property, not including a passenger bus, passenger automobile, motorcycle, panel delivery truck, or pickup truck.
Driver or operator.
Every person who drives or is in actual physical control of a vehicle.
Hazardous material.
Any quantity, group, form, or class of material designated as hazardous material in any official publication of the Secretary of Transportation of the United States pursuant to the Hazardous Materials Transportation Act, as amended, or any federal Department of Transportation hazardous materials regulations, or any provision of the state as set forth in the Texas Transportation Code, or which may be enacted by the state department of transportation, and any amendment of any of same which may hereafter be enacted.
Motor vehicle.
Every vehicle which is self-propelled.
Place of business origin.
Any place within the town limits from which a commercial motor vehicle embarks for the purpose of conducting the routine business activities normally associated with said vehicle. Points of business origin shall include truck terminals, motor fuel stations, garages, places of repair, places of performing a service, and places of loading or unloading.
Requiring placards.
The material to be transported is hazardous and is in sufficient quantity to require placarding in accordance with the Department of Transportation hazardous materials regulations (49 U.S.C. section 5101 et seq. (1976)) or in accordance with V.T.C.A., Transportation Code, chapter 644, as amended, or regulations promulgated under the authority of such chapter 644, as amended.
Roadway.
That portion of a street or highway improved, designed, or ordinarily used for vehicular travel, exclusive of the berm or shoulder.
Semitrailer.
Every vehicle of the trailer type so designated or used in conjunction with a motor vehicle that some part of its own weight and that of its own load rests upon or is carried by another motor vehicle.
Street or highway.
The entire width between the boundary lines of every right-of-way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel, including any shoulder of any street or highway.
Trailer.
Every vehicle without motive power designed or used to carry property or passengers wholly on its own structure and to be drawn by a motor vehicle.
Transport.
To move any motor vehicle requiring placards upon any public street or highway.
Truck-tractor.
Every motor vehicle designed or used primarily for drawing other vehicles and not so constructed as to carry a load other than a part of the weight of the vehicle and load so drawn.
Vehicle.
Every mechanical device in, upon, or by which any person or property is or may be transported or drawn upon a public highway, including motor vehicles, commercial motor vehicles, truck-tractors, trailers, travel trailers and semitrailers, severally, as herein defined, but excepting devices moved by human power or used exclusively upon stationary rails or tracks.

(a) 
Use of truck routes required.
No person shall operate or cause to be operated any truck or other commercial motor vehicle on a public street in the town limits without business destination or point of business origin within the corporate limits of the town except upon streets designated as truck routes; provided, however, this section shall not apply to emergency vehicles operating in response to emergency calls nor the vehicles operated by a public utility in the performance of inspection or maintenance functions. Such truck with a business destination or point of business origin within the corporate limits of the town shall be operated only on truck routes or on the shortest street route between such business designation or point of business origin and the nearest truck route. The driver of any such truck or commercial motor vehicle shall, at all times such truck or commercial motor vehicle is operated off a truck route, carry with him a bill of lading or other written evidence showing all points of business origin and business destination within the town.
(b) 
Truck routes designated.
The following streets or parts of streets are designated as truck routes:
(1) 
Interstate Highway 35 W.
(2) 
State Highway 114.
(3) 
FM 1171.
(4) 
FM 407.
(5) 
FM 156.
(6) 
Cleveland Gibs Road.
(7) 
Florance Road.
(8) 
Faught Road.
(9) 
Mulkey Road.
(c) 
Parking of heavy vehicles.
No person, firm or corporation shall park, allow to remain standing, cause to park, or cause to allow to remain standing on any street or highway, public park, public parking lot, public right-of-way, public easement or other public property in the town any commercial vehicle, any semitrailer, any truck-tractor, any dump truck, or any truck or trailer having a maximum registerable axle weight in excess of 20,000 pounds per axle.

No person shall knowingly transport hazardous materials or knowingly cause hazardous materials to be transported upon any public street within the corporate limits of or under the jurisdiction of the town, except as follows:
(1) 
The transporting vehicle is on a designated truck route.
(2) 
The transporting vehicle is empty.
(3) 
The transportation of hazardous materials is to a point of destination within the corporate limits of the town or is from a point of origin within the corporate limits of the town, or both, and no portion of such transportation was in violation of any other sections of this division.

All of the regulations provided in this division are hereby declared to be governmental and for the health, safety and welfare of the general public. Any member of the town council or any town official or employees charged with the enforcement of this division, acting for the town in the discharge of his/her duties, shall not thereby render himself or herself personally liable, and he/she is hereby relieved from all personal liability for any damage that might accrue to persons or property as a result of any act required or permitted in the discharge of his/her duties.
