The words and phrases used in this article, unless the context otherwise indicates, shall have the following meanings:
City.
The City of Bee Cave, Texas.
Unauthorized vehicle.
A motor vehicle, other than an emergency vehicle owned by, or the operation of which is authorized by a governmental entity, that:
(1) 
Is in or obstructs a vehicular traffic aisle, entry, or exit of a parking facility;
(2) 
Prevents a vehicle from exiting a parking space in a parking facility;
(3) 
Is in or obstructs a properly marked fire lane;
(4) 
Does not display the special license plate issued under section 504.201, Transportation Code, or the disabled parking placard issued under chapter 681, Transportation Code, for a vehicle transporting a disabled person and is in a parking space that is designated for the exclusive use of a vehicle transporting a disabled person;
(5) 
Is parked in an area in which parking is prohibited under this code, or which is authorized for removal by a police officer or law enforcement agency, including but not limited to sections 16.04.004(13), 18.03.003, and 18.03.004; or
(6) 
Is in an area designated as prohibited or restricted for parking in the manner described in section 18.04.003 of this article.

Except to the extent that they are supplemented or explained by this article, the standards and provisions of subchapters A, E, F, G, H, and J of chapter 2308, Texas Occupations Code, are hereby adopted.

(a) 
A motor vehicle may be towed from an area or parking facility in the city in which parking of motor vehicles is prohibited or restricted provided that a sign prohibiting unauthorized vehicles in the area [is]:
(1) 
Facing and conspicuously visible to the driver of a vehicle that enters the area or parking facility;
(2) 
Located:
(A) 
On the right or left side of each driveway or curb cut through which a vehicle can enter the area or parking facility, including an entry from an alley abutting the area; or
(B) 
At intervals along the entrance so that no entrance is farther than 25 feet from a sign if:
(i) 
Curbs, access barriers, landscaping, or driveways do not establish definite vehicle entrances in an area or onto a parking facility from a public roadway other than an alley; and
(ii) 
The width of an entrance exceeds 35 feet;
(3) 
Permanently mounted on a pole, post, permanent wall, or permanent barrier;
(4) 
Installed in the area or on the parking facility; and
(5) 
Installed so that the bottom edge of the sign is no lower than five feet and no higher than eight feet above ground level.
(b) 
Each sign prohibiting or restricting the parking of unauthorized vehicles shall be erected pursuant to section 18.01.002 and shall:
(1) 
Be made of weather-resistant material;
(2) 
Be at least 18 inches wide and 24 inches tall;
(3) 
Contain, in bright red on the uppermost portion of a sign or on a separate sign placed immediately above the sign, the international symbol for towing vehicles, which is a solid silhouette of a tow truck towing a vehicle on a generally rectangular white background, at least four inches in height;
(4) 
Beneath the symbol for towing vehicles, contain the words “towing enforced” or a statement describing who may park in the area or parking facility and prohibiting all others, in letters at least two inches in height and consisting of white letters on a bright red background;
(5) 
Bear the words “unauthorized vehicles will be towed at owner’s or operator’s expense” in letters at least one inch in height and consisting of bright red letters on a white background;
(6) 
Contain a statement of the days and hours of towing enforcement in letter at least one inch in height on a white background;
(7) 
Contain a number, including the area code, in letters at least one inch in height, of a telephone that is answered 24 hours a day to enable an owner or operator of a vehicle to locate the vehicle, in letters at least one inch in height in white on a bright red background; and
(8) 
If desired, include the name and address of the storage facility to which the vehicle will be towed, consisting of white letters on a bright red background.

A police officer is authorized to remove or cause the removal of a vehicle from a street or public right-of-way to a vehicle storage facility designated by the chief of police, when the officer determines, in good faith, that removing the vehicle is necessary for public safety and:
(1) 
The vehicle is in an accident and the vehicle’s owner or operator fails to show evidence of financial responsibility as required under chapter 601 of the Texas Transportation Code, as amended; or
(2) 
The vehicle is stopped by a police officer for an alleged violation of a city or state traffic law or other law applicable to the operation of a vehicle on the roadway and the vehicle’s owner or operator fails to show evidence of financial responsibility as required under chapter 601 of the Texas Transportation Code, as amended.
