This article shall be known as "A Local Law Opting Out of the
Enforcement and Administration of the New York State Uniform Building
and Fire Code Pursuant to § 381 of the New York State Executive
Law."
The Town of Lowville hereby opts out of the enforcement and
administration of the New York State Building and Fire Code pursuant
to the provisions of New York State Executive § 381 and
declares its intention to transfer such functions to the County of
Lewis. Such opting out shall be fully effective upon the adoption
of this article and the implementation of an intermunicipal agreement
with the County of Lewis providing for the County to perform such
enforcement and administration.
Should any paragraph, provision, or part of this article be
found by a court of competent jurisdiction to be void or invalid for
any reason, such paragraph, provision, or part so found shall be the
only paragraph, provision or part so rendered void or invalid, and
every other paragraph, provision or part shall remain in effect.
This article shall take effect immediately upon filing in the
office of the New York State Secretary of State.
