The City Council shall appoint a City Manager who shall be the
chief administrative and executive officer of the City and shall be
responsible to the City Council for the efficient administration of
all the affairs of the City. He shall be chosen by the City Council
solely on the basis of his executive and administrative training,
experience and ability, and need not, when appointed, be a resident
of the City of Beaumont, but during his tenure of office he shall
reside within the City. No member of the City Council shall, during
the time for which he is elected, be chosen as City Manager.
The City Manager shall not be appointed for a definite term
but may be removed at the will and pleasure of the City Council by
a vote of the majority of the entire Council. If removed after serving
six (6) months, he may demand written charges and the right to be
heard thereon at a public meeting of the City Council prior to the
date on which his final removal shall take effect; but pending such
hearing, the City Council may suspend him from office. The action
of the City Council in suspending or removing the City Manager shall
be final, it being the intention of this Charter to vest all authority
and fix all responsibility for such suspension or removal in the City
Council. In case of the absence or disability of the City Manager,
the City Council may designate some qualified person to perform the
duties of the office during such absence or disability. The City Manager
shall receive such compensation as may be fixed by the City Council.
The City Manager shall be the chief administrative officer of
the City and shall be responsible to the City Council for the administration
of all City affairs placed in their charge by or under this Charter.
The City Manager shall have such implied authority as to properly
carry out the functions of chief administrative officer for the City
and, in addition to those implied powers, shall have the following
specific responsibilities and duties:
(1) Appoint and remove all heads of departments and all subordinate officers
and employees of the City except as otherwise provided by this Charter
and except as he may authorize the head of a department or office
to appoint and remove subordinates in such department or office. The
decision of the City Manager or other appointing officer shall be
final and there shall be no appeal therefrom to any other office,
body or court whatsoever.
(2) Prepare the budget annually and submit it to the City Council and
be responsible for its administration after adoption.
(3) Prepare and submit to the City Council as of the end of the fiscal
year a complete finance report for the preceding year.
(4) Keep the City Council advised of the financial condition and future
needs of the City and to recommend to the City Council for adoption
such resolutions as he may deem necessary or expedient.
(5) Supervise the preparation of agendas for all meetings of the City
Council. The agendas shall be prepared in accordance with Rules and
Procedures adopted by the City Council and as provided for in this
Charter.
(6) Oversee the purchasing of all merchandise, materials, supplies and
services as budgeted and shall put in place such rules and regulations
governing contracts, requisitions and transactions of business between
City departments and vendors of goods and services in compliance with
all State procurement laws.
(7) Supervise City communication with the public and the news media including
outreach initiatives to the citizens and general public through various
media venues.
(8) Except as otherwise provided for in this Charter the City Manager
shall direct and supervise the administration of all departments,
offices and public utilities of the City and shall investigate or
cause to be investigated as appropriate any complaints concerning
the administration of the City.
(9) Appoint, suspend or remove any City employee except as otherwise
provided by this Charter. The City Manager may authorize any employee
who is subject to the City Manager's direction and supervision
to exercise these powers with respect to subordinates in that employee's
department, office or agency.
(10) Direct and supervise the administration of all departments, officers,
and agencies of the City, except as otherwise provided by this Charter
or by law.
(11) Establish personnel policies and procedures to be adopted by City
Council and make said policies available to all City employees.
(12) The City Manager shall have the authority to create and revise the
City's organizational chart.
(13) Perform such other duties as may be prescribed by this Charter or
required of him by the City Council not inconsistent with this Charter.

Neither the City Council nor any of its committees or members
shall dictate the appointment of any person to, or removal from, office
or employment or discipline by the City Manager or any of his subordinates
or in any manner interfere in the appointment or removal or discipline
of employees under the City Manager's authority. Except for the purpose
of inquiries and investigations, unless otherwise provided in this
Charter, the City Council and Members of City Council shall deal with
City officers and employees who are subject to the direction and supervision
of the City Manager solely through the City Manager, and neither the
City Council nor Members of City Council shall give orders to any
such officer or employee, either publicly or privately.
