As used in this article, the following terms shall have the meanings indicated:
OPEN-AIR MARKET
A public marketplace not contained in an enclosed building on City-owned property where food and merchandise are sold.
VENDORS
Private individuals, sole proprietorships, or business entities who sell or provide food, drink, merchandise, services, or information to the public whether or not for profit.
Open-air markets are established at the following locations:
A. 
The Community Pavilion at Frank J. Hutchins Memorial Park.
B. 
The Congress Avenue right-of-way between the intersections of St. John/Market Streets and South Washington Street.
A. 
The Director of Administration or designee shall develop the policies and procedures by which the open-air market spaces shall be rented to vendors or representative organizations of vendors.
B. 
Leases shall be negotiated by the Director of Administration or designee.
C. 
Leases shall be approved by the City Council by resolution.
A. 
Street performers may apply for a permit to perform at any public open-air market established under this article.
B. 
The Director of Administration or designee shall develop the policies or procedures for permitting of street performers.
C. 
The fee for a permit for street performers shall be set forth in the Fee Schedule.
D. 
Amplified sound by public performers is not permitted at the open-air market located at the Community Pavilion at Frank J. Hutchins Memorial Park.
