For the purposes of this article, the following words and phrases shall have the meanings herein indicated:
BUILDING DRAIN
Part of the lowest horizontal piping of a drainage system which receives the discharge from soil, waste and other drainage pipes inside walls of the building and conveys it to the building sewer, beginning five feet outside the interface of the building wall.
BUILDING MAIN
Extension from the water system of any structure to the lateral of a main.
BUILDING SEWER
Piping carrying liquid wastes from a building to the treatment or holding tank or to the public sewer main.
IMPROVED PROPERTY
Any property with the Township of West Rockhill's Water and sewer district upon which there is erected a structure intended for continuous or periodic habitation, occupancy or use by human beings or animals.
INDUSTRIAL ESTABLISHMENT
Any improved property located within the West Rockhill Water and sewer district and used or intended for use, wholly or in part, for the manufacturing, processing, cleaning, laundering or assembling of any product, commodity or article.
LATERAL
A. 
Part of the water system extending from a main to the curbline or, if there shall be no curbline, extending to the property line; or
B. 
If no such lateral shall be provided, "lateral" shall mean that portion of, or place in, a main which is provided for connection of any building main.
LOT
A designated parcel, tract or area of land established by a plat or otherwise as permitted by law and to be used, developed or built upon as a unit.
MAIN
Any pipe or conduit constituting a part of the water system used or usable for water distribution purposes.
OWNER
Any person vested with ownership, legal or equitable, sole or partial, of any improved property.
PERSON
Any individual, partnership, company, association, society, trust, corporation, municipality, municipal authority or other group or entity.
PUBLIC SEWAGE SYSTEM
Sewer system and the treatment facility owned, operated or maintained by a municipality or municipal authority approved by the Department of Environmental Protection under a permit issued pursuant to the Clean Streams Law, Act of June 22, 1937, P.L. 1987, No. 394, 35 P.S. § 691.1 et seq. (1982), as hereafter amended supplemented, modified or reenacted by the General Assembly of Pennsylvania.
SEWAGE
Any substance that contains any of the waste products or excrementitious or other discharge from the bodies of human beings or animals and any noxious or deleterious substances being harmful or inimical to the public health, or to animal or aquatic life, or to the use of water for domestic water supply or for recreation.
WATER AND/OR SEWER DISTRICT
Areas within the Township, as defined in § 414-22 of this article, in which the provisions of this article apply.
WATER SYSTEM
All facilities, as of any particular time, for production, transmission, storage and distribution of water in the Township of West Rockhill owned, operated and maintained by a municipality or municipal authority with jurisdiction.
A. 
The owner of any improved property within the Water District abutting upon the water system, except any improved property which shall constitute an industrial establishment or a farm which has its own supply of water for uses other than human consumption, shall connect such improved property with, and shall use such water system in such manner as the Township of West Rockhill may require, within 60 days after notice to such owner from the Township of West Rockhill to make such connection; subject to such limitations and restrictions as shall be established herein or otherwise shall be established by the Township of West Rockhill.
B. 
The notice by the Township of West Rockhill to make connection to a water main referred to in § 414-20A shall consist of a copy of this article, including any amendments and/or supplements at the time in effect, or a summary of each section thereof, and a written or printed document requiring the connection in accordance with the provisions of this article and specifying that such connection shall be made within 60 days after the date such notice is given or served. Such notice may be given or served at any time after a main is in place which can deliver water to the particular improved property. Such notice shall be given or served upon the owner in accordance with the law.
A. 
Except as otherwise provided in this section, each improved property shall be connected separately and independently with a main through a building main. Grouping of more than one improved property on one building main shall not be permitted, except under special circumstances and for good cause shown, but then only after special permission of the Township of West Rockhill, in writing, shall have been secured and only subject to such rules, regulations and conditions as may be prescribed by the Township of West Rockhill, or its designate.
B. 
All costs and expenses of construction of a building main and all costs and expenses of connection of a building main to a main shall be borne by the owner of the improved property to be connected; and such owner shall indemnify and shall save harmless the Township of West Rockhill, or its designate, from all loss or damage that may be occasioned directly or indirectly, as a result of construction of a building main or of connection of a building main to a main.
C. 
A building main shall be connected to a main at the place designated by the Township of West Rockhill and where, if applicable, the lateral is provided. A smooth, neat joint shall be made and the connection of a building main to the lateral shall be made secure and watertight.
D. 
If the owner of any improved property located within the Water District of the Township of West Rockhill and abutting upon the water system, subject to the exception provided for in § 414-20A after 60 days' notice from the Township of West Rockhill, in accordance with § 414-20A shall fail to connect such improved property, the Township of West Rockhill, or its agent, may construct such connection and collect from such owner the costs and expenses thereof in any manner permitted by law.
The Township of West Rockhill hereby establishes Water and Sewer Districts for the purposes of providing water and sewer service to the improved properties located within the district. The Water and Sewer Districts shall encompass the areas of Old Bethlehem Pike as more specifically described on the sewer service area map attached hereto and incorporated herein as Exhibit "A", and the water service area map attached hereto and incorporated herein as Exhibit "B." The provisions of this article shall not apply to areas which are within West Rockhill Township but outside of these Water and Sewer Districts. The Board of Supervisors may establish additional regulations and requirements to further the administration of this article, and it may establish additional Water and/or Sewer Districts from time to time by separate resolution.
A. 
All property owners whose property lies within 150 feet of any public sewer within the West Rockhill Township Water District shall be required to connect to that public sewer line.
B. 
If the owner of any property, after 60 days' notice from the Township of West Rockhill to make connection of such property with the public sewage system within the Water District shall fail to make such connection, the Township of West Rockhill, or its designate, may make the connection and collect the costs thereof in the manner provided by law.
C. 
The Township of West Rockhill, or its authorized agent, shall have access at all reasonable hours of the day to all parts of the premises to which sewage service is supplied to make necessary inspections.
A. 
All costs and expenses incident to the installation and connection of the building sewer shall be borne by the owner. The owner shall indemnify the Township of West Rockhill, or its designate, from any loss or damage that may directly or indirectly be occasioned by the installation of the building sewer.
B. 
Separate connections required; exception.
(1) 
A separate and independent building sewer shall be provided for every building.
(2) 
Exceptions to this provision shall be made where one building stands to the rear of another on an interior lot and no sewer line is available or can be constructed to the rear building through an adjoining alley, court, yard or driveway, in which case the building sewer from the front building may be extended to the rear building only on approval of the Township of West Rockhill.
(3) 
Such connection of two buildings to the sewer lines shall be considered as two building sewers.
C. 
All material and specifications for sewer pipes and joints, including size and slope of the building sewer, elevation, grade and depth of building sewer and connections to public sewage system, shall be governed by regulations of the applicable sanitary sewer service provider for all sewer service within the sewer district established herein.
D. 
The owner shall notify the applicable sanitary sewer service provider when the building sewer is ready for inspection and connection to the public sewer, and the connection must be made with the approval and under the supervision of the applicable sanitary sewer service provider.
E. 
All excavations for building sewer installation and connection shall be adequately guarded with barricades and lights so as to protect the public from hazard. Streets, sidewalks, parkways and other public property disturbed in the course of the work shall be restored in a manner satisfactory to the Township of West Rockhill.
West Rockhill Township does hereby delegate to East Rockhill Township as to sewer service, and Perkasie Borough Authority as to water service, all powers and duties necessary to implement the purpose and intent of this article within the defined Water and Sewer Districts as applicable. East Rockhill Township as to sewer service, and Perkasie Borough Authority as to water service, shall act as West Rockhill Township's designated agent in the implementation and purposes of this article within the respective Water and/or Sewer Districts.
Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be subject to pay a fine of nor more than $1,000, and in default of payment, to imprisonment for a term not to exceed 30 days. Each day that a violation of this article continues shall constitute a separate offense.
If any sentence, clause, section, or part of this article is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, sections or parts of this article. It is hereby declared as the intent of the Board of Supervisors that this article would have been adopted had such unconstitutional, illegal, or invalid sentence, clause, section or part thereof not been included herein.
