(a) 
Prohibited.
It shall be unlawful and an offense for any person to discharge a firearm, rifle, shotgun, automatic rifle, revolver, pistol or other weapon designed for the purpose of firing or discharging a shell or cartridge in the city limits.
(b) 
Defenses.
It shall be a defense to prosecution under this section if:
(1) 
The person was a law enforcement officer or peace officer acting in the performance of his official duties at the time of discharge of such weapon;
(2) 
The person was at a shooting range operated by a public agency or one privately operated under the appropriate provisions of law;
(3) 
The person was using blank cartridges for a show or theatrical production, for signal or ceremonial purposes in athletics or sports, or by a military organization;
(4) 
The person was a duly appointed and acting animal control officer of the city acting in the performance of his official duties, or the person was acting in lawful defense of life and/or property;
(5) 
The person was a federal, state or municipal employee acting in the performance of his official duties for the purpose of wildlife management;
(6) 
The person was discharging a shotgun, air rifle or pistol, BB gun, or bow and arrow on a tract of land that is ten (10) acres or more that was annexed by the city after September 1, 1981, and the discharge was more than one hundred fifty (150) feet from a residence or occupied building located on another property and was in a manner not reasonably expected to cause the projectile to cross the boundary of the tract;
(7) 
The person was discharging a center fire or rim fire rifle or pistol of any caliber on a tract of land of fifty (50) acres or more that was annexed by the city after September 1, 1981, and the discharge was more than three hundred (300) feet from a residence or occupied building located on another property and was in a manner not reasonably expected to cause a projectile to cross the boundary of the tract; or
(8) 
The person was discharging a firearm in the extraterritorial jurisdiction of the city.
(c) 
Penalty.
Any person violating any of the provisions of this section shall be deemed guilty of a misdemeanor and upon conviction in the municipal court shall be subject to a fine in accordance with the general penalty provision found in section 1.01.009 of this code.
