(a)
Conversion of a garage or carport converted for human occupancy, constructed without a permit, shall be allowed to remain conditioned on compliance with the requirements set forth herein.
(b)
The city council hereby grants a moratorium on enforcement of the city building, electrical and plumbing codes for a period of two (2) years for all owners or occupants of residential structures for converted garages and carports which have been converted for human occupancy, subject to the following conditions:
(1)
That every such owner(s) or occupant(s) who has caused, permitted, suffered or allowed such conversion without the appropriate permit(s) notify the city code official of such conversion within one hundred eighty (180) calendar days of the effective date of this section.
(2)
That, upon such notice, such owner(s) or occupant(s) shall consent to inspection of such converted garage or carport for compliance with applicable building, electrical, plumbing and fire codes.
(3)
That every such owner(s) or occupant(s) shall pay an inspection fee as established by the city council.
(4)
That the code official shall, after such inspection, give notice of related code deficiencies, if any, to such owner(s) or occupant(s).
(5)
That every such owner(s) or occupant(s) shall make the necessary and/or appropriate repairs to bring such converted garage or carport into compliance with the building, electrical, plumbing or fire code, and such owner(s) or occupant(s) shall obtain the appropriate permit to conduct such repairs.
(c)
If a home with a converted garage or carport was brought into compliance by the owner(s) or occupant(s), and then the home was destroyed over fifty (50%) percent of its value, the owner(s) or occupant(s) may rebuild the home with the additional room and would not have to rebuild with the two (2) car covered parking space.
(d)
The provisions hereof are not applicable to any residential structure currently under permit or being constructed, and nothing contained herein shall be construed to create any right or entitlement past the expiration date as provided herein.
(e)
The moratorium granted herein shall expire without further action on July 1, 2002.
(f)
Any person, firm or corporation violating any of the provisions of this section or the development code of the city, as amended hereby, shall be deemed guilty of a misdemeanor and, upon conviction in the municipal court of the city, shall be subject to a fine in accordance with the general penalty provision found in section 1.01.009 of this code, and each and every day such offense shall continue shall be deemed to constitute a separate offense.
