Occasional sale.
Garage sales, patio or porch sales or lawn sales. The sale of tangible personal property at retail within the city limits by a person or persons who do not hold themselves out as engaging, or do not habitually engage in, selling such property commercially.
Tangible personal property.
Property that belongs to the seller personally and has not been purchased or obtained from other persons for the purpose of resale.

Any person who violates any provision of this article shall upon conviction be punished by a fine in accordance with the general penalty provision found in section 1.01.009 of this code, and each day’s failure of compliance with any such provisions shall constitute a separate violation.

It shall be unlawful for any person to conduct within the city limits an occasional sale without first obtaining a license for such occasional sale. An application for such license shall be made to the city manager or his/her designee in writing and shall state the following:
(1) 
Name and address of the applicant;
(2) 
Dates of the sale;
(3) 
Signature of the applicant acknowledging that he/she has received a copy of the regulations.

(a) 
An occasional sale license shall be issued only to the resident of the address where the occasional sale is to be held.
(b) 
An occasional sale shall be held only at a person’s place of residence and not on commercially used property, except as may be provided for nonprofit organizations.
(c) 
An occasional sale license is valid only for three (3) consecutive days, and no more than one (1) occasional sale may be held during any six (6) month period at any single address.
(d) 
Licenses issued for occasional sales must be posted in a place where the permit shall be visible to the public.
(e) 
The city manager or his/her designee may authorize an occasional sale license for up to three (3) days for activities conducted by and for the benefit of a religious, charitable, philanthropic or other nonprofit organization. The location of such sales is allowed at locations other than a residence if approved by the property owner of said location, including commercially utilized properties.
(f) 
The city reserves the right to suspend issuance of occasional sale licenses where such sale conflicts with other special events that are likely to create disturbances and traffic congestion.
(g) 
This section is not intended to prohibit commercial establishments from sidewalk sales or truckload sales as would normally be associated with their business operation.

(a) 
One (1) sign is permitted, not to exceed two (2) square feet, upon the property where the sale is taking place. All other signs advertising such sale are prohibited.
(b) 
The city may remove and destroy any signs prohibited under this section.
